CHAPEL-EN-LE-FRITH PARISH COUNCIL

MINUTES OF THE ORDINARY MEETING HELD ON 1 JUNE  2010

Meeting Held:          Tuesday 1 June 2010 in the Annexe of the Town Hall, Chapel-en-le-Frith

11/43                          Declarations of Interest

Councillor Bayirli declared an interest as she is employed by Derbyshire Constabulary.

11/44              Police Matters

It was reported that there has been an increase in damage in the Memorial Park, with incidents being reported to the Police.

11/45              Open Forum

There were no members of the public wishing to participate.

11/46              Highways, Public Footpaths and Public Services

A request has been received from a resident of Meadow Lane, Dove Holes, following two recent accidents outside his property and seeking an extension to the 30mph speed limit.  The Police will undertake some speed checks in this area and it was suggested that a flashing warning light may be appropriate.  This will be taken up with the County Council and they will be reminded that they were going to undertake some traffic checks in this area.

Derbyshire County Council have issued a consultation document on the Local Transport Plan.  It was agreed that the questionnaire should be completed at the next Planning Committee.

The Clerk was asked to report a sign on Midland Road which is obscured by a overhanging tree.

The Clerk was asked to pass on complaints about pavement sweeping where only a part of the area is swept leaving debris at either side.

Members felt that an annual litter pick on the A6 by-pass is insufficient further information will be sought as to why litter can only be picked when the road is closed.

Solar Tech, the suppliers of the Solar Light have indicated that they can now provide a cost for installation and it was agreed that all the providers be asked to re-quote for the work.

11/51              Matters arising from the above Minutes

Councillor FP Harrison arrived at 8.10pm

The Clerk was asked to query Councillor Critchlow’s comments at the last meeting regarding the adoption of the estate of Hallsteads in Dove Holes to ascertain who will be responsible for bringing the highway up to standard.

Members were circulated with a copy of the notes from the meeting with Derbyshire County Council and High Peak Borough Council to discuss grass cutting.

The Friends of the Memorial Park Group have submitted the application for grant funding for the MUGA.  The Trustees of the Chapel Memorial Fund have indicated that they will be willing to make a grant of £2,000 towards the project.

A meeting will be arranged with the Housing Officer at High Peak Borough Council to discuss the Housing Needs Survey.

Members were reminded that a Chairman will need to be elected at the next Planning Committee.

Councillor S Young advised members that he has been elected as Vice Chairman of the Borough Council Planning Committee and will therefore not attend Parish Planning Committees.

It was reported that High Peak Borough Council are looking to extend re-cycling to businesses.

The Standing Orders will be presented to Full Council in July for approval.

The Chairman of the F & GP Committee advised members that the Insurance has now been arranged with DE Ford and this will result in an immediate saving and a further saving next year.  He did not take part in the vote at the  F & GP Committee on this issue as he had prepared the paper presented to the Committee.

11/52              Outside Bodies

Members were circulated with the Minutes of the Friends of the Memorial Park meetings.

11/53              Town Hall

The energy survey has been completed and a report is awaited.

The Regeneration Partnership will be asked to provide funding towards the Town Hall frontage project.

11/54              Circulars

Members were given details of a DALC Training Course to be held in New Mills on 26 July 2010.  Members were asked to book a place with the Clerk.

11/55              Parks and Open Spaces

The Friends of the Park Group have received a complaint from a member of the public about dogs that are not on leads and asking if the by-laws are being enforced.

The skate park was vandalised on Monday 24 May  and 2 benches have been smashed during the last  weekend in the Memorial Park.  Both incidents have been reported to the Police.

LEADER have confirmed that the Council have been successful in obtaining the grant for the War Memorial refurbishment.  An application for Listed Building Consent will be lodged with High Peak Borough Council prior to the commencement of any work.  It was agreed that Councillor Martin will oversee the project

It was agreed that a Press Release be issued when the Dove Holes hanging baskets are erected and that Councillor Mrs Armstrong as Ward Member and Councillor Mrs Young as Quarry Liaison representative together with representatives from Tarmac be photographed on site.

The new play equipment has been installed at Needham Recreation Ground and there have been favourable comments from neighbours of the site.

The Clerk was asked to contact the Carnival Committee to secure a bond against damage in the Memorial Park.

Councillor FP Harrison declared an interested in this item as President of the Carnival.

A resident has complimented the Park staff on their work and asked that his be conveyed to them.

11/56             Allotments

Following the letter to all the residents currently waiting for an allotment at the Courses allotment site, 10 residents have confirmed that they would be interested in a temporary plot at the Leys.  A further 5 people said that they wanted to wait for a plot on the Courses and the remainder did not reply.  A tenancy agreement has been drawn up for the temporary plots on the Leys site.

Councillor Martin proposed and Councillor Mrs Young seconded that the Leys allotment site be re-opened on a temporary basis and members were in agreement.

11/57              Correspondence

An invitation has been received inviting two members to attend the Derbyshire Constabulary Annual Parish Councils evening on Tuesday 12 October 2010 in Ripley.  Councillors M Harrison and Mrs A Young will attend.

Invitation to attend a seminar on the Joint Core Strategy on 7 June, 6.30pm at Chinley Offices.  Councillors M Harrison, Norton, Mrs AS Young and S Young will attend.

A letter has been received from the new MP seeking a date when he can come along and meet the Council.

Members are invited to a presentation at Combs Village Hall regarding their recent energy saving project on !9 June at 10.30am.

Derbyshire County Council are seeking comments on the Minerals Core Strategy which affects areas with quarrying.  It was agreed that this be discussed at the next Planning Committee.

Members are invited to the AGM of Chapel-en-le-Frith Mobile Physiotherapy Service on 23 June 2010.

The CPRE AGM will take place on 17 June 2010 and members are invited.

11/58              Schedule of Accounts presented for payment

The Clerk submitted a list of accounts for which cheques numbered 005745 to 005779 amounting to £18,646.35 has been drawn.

RESOLVED:  That the cheques be signed and the accounts to which they relate be paid.

The Clerk submitted the Annual Statement of Accounts, Annual Governance Statement and Internal Audit Report.

There were no matters arising from the Internal Auditors report.

Members were made aware of the Annual Governance Statement and the individual sections 1 – 9, which was approved.

RESOLVED:  That the Annual Statement of Accounts, Annual Governance Statement and Internal Audit Report is approved and be submitted to the District Auditor.

11/59              Any Other Business

The Community Awards Committee will meet at 7pm on 8 June to make arrangements for the presentation.

An F & GP Committee was arranged for 7pm on 22 June 2010, followed by an Amenities Committee at 7.30pm.

The Christmas dinner was arranged for 10 December 2010 at Chapel-en-le-Frith Golf Club.

MINUTES OF THE ANNUAL MEETING HELD ON 4 MAY 2010

Meeting Held:          Tuesday 4 May 2010 of the Annexe of the Town Hall,

                                    Chapel-en-le-Frith.

Present:                    Councillor VGB Martin in the Chair

Councillors Mrs Armstrong, Mrs Batterbee,  Mrs Bayirli, Brookfield, FP Harrison, M Harrison, Smith, Mrs A Young and S Young.

In Attendance:        Mrs S E Stockdale – Clerk to the Council

Apologies for absence were received from Councillors Clarey, McCarthy and Norton. PC I DePee and PCSO J Shaw.                               

At the commencement of the meeting there was one member of the Press and two members of the public present.

Prayers were said by Rev Leach.

Councillor Martin expressed his thanks to the Vice Chairman, Chaplin and Clerk for all the assistance they had given him during his Chairmanship.

11/1                Election of Chairman

The first item of business transacted was the election of Chairman.  Councillor Mrs Young proposed and Councillor Smith seconded that Councillor M Harrison be elected as Chairman.  There being no further nominations it was therefore

RESOLVED:  That Councillor M Harrison be elected as Chairman of the Parish Council for the period to the next Annual Meeting of the Council.

Councillor M Harrison took the Chair.

The Chairman thanked the outgoing Chairman for all his hard work during the last 2 years.

11/2                Appointment of Vice Chairman

Councillor Martin proposed and Councillor FP Harrison seconded that Councillor Norton be elected as Vice Chairman. 

Prior to a vote being taken Councillors Mrs Armstrong, Mrs Bayirli and Brookfield were asked if one of them they wished to stand.

There being no further nominations it was therefore

RESOLVED:  That Councillor Norton be elected as Vice Chairman of the Parish Council for the period to the next Annual Meeting of the Council.

11/3                Dates and times of Meetings of the Parish Council

RESOLVED:  That for the period until the next Annual Meeting of the Council, Ordinary Meetings of the Council will be held on the first Tuesday of each month in the Annexe of the Town Hall, Chapel-en-le-Frith, commencing at 7.30pm.

RESOLVED:              That the next Annual Meeting of the Council be held on Tuesday 3 May 2011. 

RESOLVED:  That the Annual Parish Meeting be held on Wednesday 20th April 2011.

11/4                Membership of Committees

11/6                Declarations of Interest 

Councillor Mrs Bayirli declared an interest in Police matters as she is employed by Derbyshire Constabulary.

11/7                Police Matters

The Police were thanked for their assistance at May Day together with other organisers.

It was reported that following a serious accident at Barmoor Clough Roundabout the road had been closed which resulted in total gridlock in Sparrowpit with vehicles trying to find alternative routes.  It was agreed that this was probably exacerbated by Long Hill be closed also.  It was agreed that this should be brought to the attention of the Police to enable better planning in future.

Concern was raised about School children standing on the side of roads as part of speed camera campaigns.   

11/8                Open Forum

Mrs Stafford-James addressed the Council in support of the resolution put at the Annual Parish Council meeting to re-open the Leys Allotments on a temporary basis to alleviate the current waiting list at the Courses allotment site.

She confirmed that prospective tenants would be willing to take on short term tenancy agreements and limit the type of crops grown to limit any compensation.

It was noted that the re-opening of the Leys site will involve additional administration on the part of the Council.

It was also noted that whilst Federal Mogul are willing to release further land at the Courses site, it was unlikely that this would be in the short term.

The Chairman suspended Standing Orders to seek agreement to take the agenda item on Allotments next.

Councillor Mrs Critchlow addressed the meeting to ask for details of any roads that had been damaged by gritting during the winter and the following locations were identified:-

-          Rowton Grange Road, Chapel-en-le-Frith

-          Whitehough Head Lane

-          Long Lane, Chapel-en-le-Frith to Dove Holes.

Members expressed disappointment that the priority gritting routes were not going to be reviewed.

Councillor Mrs Critchlow gave an update on the adoption of various roads in the Parish:-

-          Mirey Meadow, Chapel-en-le-Frith is unlikely to be adopted due to the adjoining road being unadopted.

-          South Head Drive, Chapel-en-le-Frith is about to be adopted with conditions attached.

-          The estate off Hallsteads in Dove Holes is about to be adopted.

Members asked for clarification on the adoption of the road from Forrester’s Way to Bowden Lane, Chapel-en-le-Frith.

Also Councillor Mrs Critchlow advised that all the waiting limits around the Market Place area were about to be reviewed.

11/9                Allotments

The Amenities Committee had proposed the following:-

That Full Council consider:

-          Allowing residents to use the Leys site on a 12 month tenancy

-          Identify what financial exposure there might be to the Council

-          Draw up Heads of Terms and seek a meeting with potential tenants of the Leys

-          Identify how many residents on the Courses waiting list would wish to take a 12 month tenancy on the Leys.

Councillor Mrs Young proposed and Councillor Martin seconded that the Council agree to the proposal made by the Amenities Committee.

RESOLVED:  That the Clerk action the agreed 4 points.

A meeting will be arranged with the Dove Holes allotment holders.

11/10              Matters relating to Highways, Public Footpaths and Public

                        Services

The Clerk was asked to write to High Peak Borough Council to see if they will provide signs to show the numbering of properties on Spencer Road, Chapel-en-le-Frith.

It was agreed that the weed spraying regime be addressed at the meeting with Derbyshire County Council and High Peak Borough Council and the forthcoming meeting to discuss grass cutting.  Also the Chairman was asked to raise it at the next meeting with High Peak Borough Council’s link officer, together with the unsafe state of the setts on the Market Place.

11/15  Matters Arising from the above Minutes

Three quotes have been received for the installation of the solar light:

Solar Tech £900 plus VAT

Harlite £750.58

Tarmac £699.99 Plus VAT

It was agreed that the quote from Tarmac be accepted and taken from the Street Lighting reserve fund.

A meeting has been arranged for 6 May to discuss grass cutting with Derbyshire County Council and High Peak Borough Council.

The Clerk was asked to remind Derbyshire County Council that the annual aggregate reinstatement on paths on Market Street is due.

There has been a delay with the installation of the Needhams play equipment due to a shortage of safety matting.

The National Trust have confirmed that they would be willing to support a scheme to create better parking at Eccles Pike and this is currently being progressed with the County Council.  A request was made to look at a better access route to the summit.

The Friends of Chapel Memorial Park are taking the MUGA project forward.

An agenda item will be added to the next Planning agenda to discuss temporary commercial signs.

A local business had queried with the Chairman of the Regeneration Partnership the policy relating to A3 planning applications in respect of cafes and restaurants.  The policy states that members cannot comment on matters of competition but can comment on applications that could have an impact of the viability of the town centre.

It was agreed that the Housing Needs Survey had identified that there are a minimum of 148 households in Chapel-en-le-Frith in housing need, should be added to the report attached to the Planning Minutes.

Members agreed that the Parish Council should be expressing a strong view on the need for affordable housing and the Officer at High Peak Borough Council with the responsibility for housing should be invited to any meetings to discuss the issue.

Councillor FP Harrison declared an interest as a Director of a Housing Association, but commented that Housing Associations would require more funding if they are to build affordable properties.

The Chairman reminded Members that without the Power of Well Being the Council would not be able to take forward any Government initiatives regarding affordable housing.

11/16              Annual Report

Members were circulated with a copy of the Annual Report.

RESOLVED:  That the Annual Report is approved.

11/17              Circulars

DALC are holding a training Course at New Mills Town Hall on 26 July 2010 on Law and Good Practice for Parish Councils.  Members will be circulated with details.

11/18              Parks and Open Spaces

As sponsorship has been secured from Tarmac for the Dove Holes hanging baskets the Dove Holes Community Association have asked if the £1,000 regeneration money they had earmarked for this purpose could be transferred to a refurbishment project at the Community Association.  All members were in favour of this proposal.

The Clerk was asked to remind the Park Manager to make an annual diary note to prepare Nanny’s Well for the Well Dressing.

The Friends of the Memorial Park have produced the completed text for the Interpretation Board and it was noted that the kissing gate should in gate be called the Spinning Ginny.

11/19              Correspondence

A letter of thanks has been received from Churches Together, thanking the Chairman and Council for their support.

Members were asked to respond to a letter from High Peak Borough Council regarding a car parking review. The scope of the review includes parking enforcement, Council Car Parks, parking hot spots / problem areas and charging policy.

The Clerk was asked to submit the following comments:

Members would not wish to see charging being introduced at either the Mirey Meadow Car Park or the Thornbrook Road Car Park in Chapel-en-le-Frith.

The reasons for this are:-

-          Morrison’s Car Park is very often at full capacity

-          There is limited waiting times on the parking spaces on Market Street and these together with free parking on the 2  public Car Parks are vital for the viability of retail outlets in the town.

-          The Thornbrook Road Car Park is used by visitors to the Doctors Surgery, Clinic and Dentist, who occupy adjoining properties.

-          High Peak Borough Council sold a substantial part of the Thornbrook Road Car Park to enable construction of the Clinic and Doctors Surgery.  This in turn gave a considerable capital gain which should protect free parking at this location.

-          The Parish Council made a financial contribution towards the creation of the Mirey Meadow Car Park, to allow free parking.

-          It has previously been considered that any gain from charging at the public Car Parks would be offset by costs for parking attendants.

In addition members commented:-

-          The Thornbrook Road Car Park needs remarking as there is an area hatched for the Council Tax Van, which no longer visits.  This would give more parking spaces.

-          A scheme to provide echelon parking on the shop frontages on Thornbrook Road should be revisited.

-          A resolution is needed in respect of parking at the junction of Bowden Lane and Hayfield Road, Chapel-en-le-Frith together with parking in the lay-by on Hayfield Road East.  It is suggested that the Borough Council should look to demolish the redundant public toilets at this location to provide additional off street parking spaces.

Councillor Mrs Armstrong left the meeting.

11/21              Any Other Business

The Clerk will arrange F & GP Committee to discuss the Insurance renewals and a meeting of the group to look at updating Standing Orders.

The Town Hall Committee were asked to consider allowing the Ladies Choir to hire the Town Hall on Bank Holidays, when the currently policy is to close.  Councillor Mrs Young declared an interest in this item.

There being no further business the Chairman declared the meeting closed at 9.30.

10/380            Police Matters

PC DePee reported that following the recent SNT Meeting, parking at Warmbrook School and the play area at South Head Drive, were the new priorities.

It was reported that a resident of the Parish had a purse snatched in a shop in Spring Gardens, Buxton.  PC DePee thought that it was probably a chance theft, but would bring it to the attention of the Safer Neighbourhood Sergeant in Buxton.  Purse chains are available from the Safer Neighbourhood Team.

Thanks were passed on from a resident on Eccles Road as the Police are dealing with tractor problems on the road.

There was a general feeling that that there is a good Police presence on the streets and PC DePee asked that he be informed if members received comments to the contrary.

10/381            Open Forum

There were no members of the public who wished to address the Council.

10/382            Highways, Public Footpaths and Public Services

A copy of a letter sent to Derbyshire County Council from the owners of the 4x4 Garage on Manchester Road has been received in respect of the yellow lines on Horderns Road.  Members felt that they could not support a proposal to alter the existing lineage on safety grounds.

Derbyshire County Council have advised that they are working to bring part of Bowden Lane up to adoptable standard at which point the street lighting will also be adopted.

A complaint has been received regarding a ‘Drive Sexy’ advert at Horderns Motor House, that it is inappropriate given the number of children who pass it on their way to school.

The Clerk was asked to report litter on the slip road onto Sheffield Road from the by-pass and Sheffield Road to the by-pass, together with litter at Morrison’s which has not yet been cleared.

Derbyshire County Council provided details of 3 approved Contractors who would be able to install the Solar Light.  Prices for the work were sought from all three with only one submitting a quote of £699.99 + VAT.  It was agreed that further quotes be obtained before the next Full Council Meeting.

Tarmac have agreed to fund the hanging baskets in Dove Holes for the coming year at a cost of £2,000.

It was noted that the tarmac repair to the steps by the Nat West Bank is temporary.

Derbyshire County Council are still waiting for a date from High Peak Borough Council for a meeting to discuss the grass cutting schedule.

The National Trust have been asked to look at a project to provide more parking on Eccles Pike.

Planning minutes 10/377 is being taken up by the Cabinet Member for Highways at Derbyshire County Council.  10/371 where a complaint has been made to High Peak Borough Council about the siting of the Tourist Sign on Hayfield Road.

A meeting has taken place with Mike Green, where the weeds and drains on the Market Place were brought to his attention.

10/387            DALC Circulars

Nominations are being sought for a vacancy on the DALC Executive Committee and the High Peak Borough Council Standards Committee.  Councillor Smith proposed and Councillor Norton seconded that Councillor G Martin be put forward for both these vacancies.

10/388            Town Hall

The Health and Safety Risk Assessment and Fire Safety Risk Assessments have taken place and the report will be considered by the Health and Safety Committee.  A meeting was arranged for 30 April 2010 at 10am.

The Licensee in respect of the gate between the Town Hall and Memorial Club has defaulted and the Licence has been withdrawn.

We have been advised that we have been successful in our bid for £909 from the National Lottery to fully fund a green energy assessment of the Town Hall.

A quote of £3.550.00 + Vat has been received from Kinder Construction in respect of a reduced scheme for the Town Hall frontage.  It was agreed that funding be sought from the Regeneration Partnership for this project.

The Chairman of Amenities advised members that discussions were still taking place with Federal Mogul regarding the additional land acquisition and members were concerned that they would not want any negotiations to be linked to a future planning application.

Copies of the ‘Have Your Say’ report 2009 have been received from Derbyshire Constabulary.

Councillor Smith reported that he had rung the Police to report an arson attack on the play area at South Head Drive and due to their speedy response a culprit had been arrested.  The group of young people gathering at the play area are those who have been moved on from Morrison’s following the Safer Neighbourhood priorities.

Concern was expressed about dangerous driving conditions  in Sparropwit with motorists travel up Peaslows Road to find that the weather conditions are much worse than in Chapel-en-le-Frith.  Residents were asked to report any incidents to the Police who would ask Derbyshire County Council to close the road if necessary in future.

Negotiations are taking place with Derbyshire County Council regarding the installation of the Solar Light in the Memorial Park.

Crime figures in the last month have been low and a number of crimes have been detected.

10/348            Highways, Public Footpaths and Public Services

Derbyshire County Council has advised that part of Dale Road, Dove Holes will be closed from 8 – 26 March 2010 for emergency stabilisation works.  The Clerk was asked to contact Derbyshire County Council to ensure that Longridge Lane was not going to be used as a short cut, given the recent problems in the Wash, when the New Smithy bridge was being repaired.

The County Council have been contacted by the Ward member about the height of the speed humps in Whitehough following the recent resurfacing of the road.  It was reported that the Council will be taking some action to restore the humps to the correct height.

The Clerk was asked to report pot holes on Rowton Grange Road by the speed humps.

The Borough Council have not yet repaired the steps by the Nat West Bank as there is an issue over responsibility which should hopefully be resolved soon.

The National Trust have signalled that there would be willing to contribute to any discussion regarding the upgrading of the small parking area on Eccles Road leading to the summit of Eccles Pike.

The Clerk was asked to report to Derbyshire County Council that BT had damaged the grass verge by the 4 x 4 garage on Manchester Road.

10/355            Matters arising from the above Minutes

High Peak Borough Council have advised that a litter pick will take place on the A6 bypass at the end of March when it is due to be closed for carriageway works.  The gullies will also be cleaned at the same time.

A litter pick of the A623 has also been requested and High Peak Borough Council have confirmed that this will be added to their work schedule. This does not appear to have been litter picked yet and will be chased up.

Derbyshire County Council have asked High Peak Borough Council to attend the meeting regarding the grass cutting schedule and a date will be arranged in March.

The Enforcement Officer has not reported back following his visit to the tenant at 47/49 Market Street regarding the new external signs.

The Clean Team were instructed to speak to the Manager at Morrison’s to ask that the area at the side of the store be litter picked and some work has taken place, but more is required.

Figures to reschedule the Public Works Loan have been received from Sector, who  have quoted an interest rate of 4.4% against the current rate of 4.62%.  In addition there would be an early repayment charge of £5,800 which would not make the rescheduling cost effective as there would be a net loss to the Council.

10/356            Outside Bodies

The Leisure Centre have reviewed their fees with any increases being between 1% and 3%.  Some charges remain unchanged.

10/357            Town Hall

The Conservation Grants Officer has indicated that English Heritage would only be prepared to grant fund any work on the Town Hall frontage to restore it to its original.  The original frontage included a wall and railings which would take away parking and not be feasible.  It was agreed that a case should be put forward that the proposed scheme is compatible with the original.

Members were given copies of minutes from a meeting held to look at the possibility of making the former Primitive Methodist Chapel into an Arts Centre for the Town Band, Male Voice Choir and other groups.  A discussion took place over the use of the balcony at the Town Hall as this could be an alternative storage space for the band.  However, this was ruled due to a number of reasons.

10/358            Parks and Open Spaces

The Carnival Committee have asked for permission to use the Memorial Park on 19th June for the Carnival and the following day as the starting point for a fun run.

Members were asked to act as judges again on Carnival Day.

10/359           Allotments

Further developments are awaited from Federal Mogul regarding the provision of additional allotment space so that the Leys site need not be re-opened.

10/301            Police Matters

It was reported that there has been a reduction in crime figures in the Division for all areas in the period 1 April 2009 to 31 January 2010.

In addition there has been a reduction of 13.2% in anti social behaviour in Chapel-en-le-Frith.

The Safer Neighbourhood Group have set one new priority, being the skateboarders outside Morrison’s having discharged the previous priorities.

Community Speedwatch volunteers have been trained and sessions have been arranged with participation from local Schools.

It is hoped that the Solar Light will be in place in the Memorial Park by Spring.

The Police were asked to look at problems with cars parking on Manchester Road blocking sight lines from Long Lane.

There have been issues on Bowden Lane when the Community Bus had difficulty manoeuvring in the turning circle at the bottom of Bowden Lane and a letter has been sent to residents in this respect.  In addition the same vehicle has had problems accessing Bowden Lane from Hayfield Road as has the refuse collection vehicle due to cars parking illegally.  It was agreed that the Vice Chairman would organise a meeting with the Police, Parking Enforcement Agency and Borough Council to seek a way to resolve these issues.  The Borough Council should be insisting that the refuse collection provider has a suitable vehicle to access narrow rural roads such as Bowden Lane as residents are not getting an acceptable level of refuse collection at present.

The Clerk was asked to report a blocked grid by the Puffin Crossing on High Street which is causing a big puddle to form.

The Clerk was asked to write to Derbyshire County Council to ask them to address the build up on litter on the A6 bypass and the A623 and to suggest that an annual litter pick is insufficient.

The grass cutting schedule has still not been supplied by Derbyshire County Council and the Clerk was asked to arrange a meeting with the County Councillors and Officers to discuss this.

Members felt that the recent bad weather had highlighted the need for better emergency planning and wish to seek a meeting with agencies involved to look at how improvements can be made in the light of recent experiences.

The Borough Councillors were asked to report concerns about the green box collections when boxes are left discarded on pavements and thrown into gardens.

The Chairman suggested that members look at the priority gritting routes with a view to suggesting additional roads.

The Clerk was asked to thank the Park staff for the efficient way in which they kept the Parish grit bins filled in the recent bad weather.

When the Co-op took the Car Park behind the store in Chapel-en-le-Frith over from the Borough Council it was on condition that it remained a public car park.  This being the case it was felt that there was a duty to keep it gritted in bad weather and that High Peak Borough Council should be taking this issue up with the Co-op.

A resident has suggested that the Friends of Chapel Station might like to consider a new sign for the Station saying Chapel-en-le-Frith Capital of the Peak, as other Stations on the line have signs highlighting their particular areas.

Councillor Martin declared an interest as a member of Friends of Chapel Station.

A request has been received for a grit bin for the hamlet of Ford and at Mirey Meadow.  Members felt that they couldn’t commit to any further bins and were not sure that a bin at Ford Hall would provide much effect.  The Clerk was asked to write to High Peak Borough Council suggesting that they provide a bin for the Car Park at Mirey Meadow, that residents could also use.

Derbyshire Constabulary have advised that they will be meeting with the cycle race organisers of the kilo to go race run from Chapel Leisure Centre, prior to the next event and will take note of comments made.

Lomas Distribution have now moved the unsightly containers on their frontage following a request from the Regeneration Partnership.

The CAB have advised that they will not be able to run a Surgery at the Town Hall as they have been unable to secure funding from the PCT in this respect.

Quotes are being sought for the refurbishment of the War Memorial and Listed Consent will be applied for to secure LEADER funding.  The refurbishment will include repairs, cleaning, inscribing the names of those who fell in WW2, restoration of the wrought iron pillars and new globe lights.

It was not clear in the minutes what the Chairman’s casting vote was on application HPK.2009/0707, which was in favour of the removal of the condition.

The Enforcement Officer is dealing with the signage at 47/49 Market Street with the Tenant.  Should enforcement need to taken it would ultimately be against the Council.  The Clerk will check the lease to determine if consent from the Council was required for new signage.

The Chairman of Planning was asked to arrange for the application HPK/2009/0567 at Owlgreave Farm to go before the Development Control Committee due to concerns about the over development of the site.

All Members were asked to attend the training session on permitted development on 16 February at 7.30pm.

10/314            Precept 2010/11

The Chairman of the F & GP Committee advised members that the committee had agreed a figure of £111,704 for the 2010/11 Precept.  This would equate to a Parish Rate of £35.51 which was the same rate as 2009/10. Councillor  Mc Carthy proposed and Councillor M Harrison seconded that the 2010/11 Precept be set at £111,704, all members were in agreement.

A response to the Needham Play Equipment consultation has been received for the neighbours nearest to the Recreation Ground, asking that the new play equipment be scattered around the grassed area to avoid having an area where young people will gather. The Clerk and Chairman of the Amenities Committee are meeting on 5 February on site with neighbours to address the issues raised.

The Amenities Committee will consider covering some grassed areas in Needham Recreation Ground and Memorial Park with honeycomb plastic tiles to create path and hard standing areas.

The Clerk was asked to arrange for the stone trough at Sparrowpit to be cleaned.

10/317           Allotments

Federal Mogul have indicated that they will look favourably at the release of additional land on their site for allotments.  However, this will form part of plans for the re-development of the site which are ongoing.

Informal advice has been sought from the Government Officer regarding the possible tenure of this land to enable to allotment status at the Leys to be lifted.  Ownership is the normal and preferred option and a lease arrangement may be considered of not less than 25 years.  There is no guarantee at this stage that this will be acceptable by the Secretary of State.

Meetings will be arranged with the management committees of both allotment sites shortly.

Residents have reported receiving unsolicited telephone calls from a company undertaking a survey on burglar alarms.  This has been the subject of recent ringmaster messages and residents are asked to pass details onto Trading Standards should it be found that companies are trying to mislead.

The Chairman thanked PCSO Julie Shaw for arranging the recent visit to the CCTV monitoring unit.

There has been a recent arrest in connection with money laundering and drug dealing and a further drug related arrest in Chapel-en-le-Frith.

It was reported that the anti social behaviour problems on Thornbrook Road had moved behind the Londis store and this is being monitored.

Pupils at Chapel Primary School have taken part in Community Speed Watch and the High School are also to take part.

There are two new Special Constables who will be aligned to the Safer Neighbourhood Teams.

10/253            Highways, Public Footpaths and Public Services

Derbyshire County Council have advised that they have not been able to complete data counts at the Dove Holes traffic lights yet, due to existing Department of Transport commitments.

Derbyshire County Council advise that the A624 at the junction of the B6062 at New Smithy will be closed from 11 January 2010 to 22 February 2010 for bridge refurbishment work.

Work will also take place at the junction of Eccles Road and Station Road from 1 – 3 February 2010.

A street trading consent is being sought from High Peak Borough Council for the Dove Holes lay-by to sell food each day from 4pm to 11pm from a mobile unit.  This will be in addition to the existing consent for a mobile unit selling food from 6am – 4pm each day.

Following consultation with the existing trader an application has been received to extend the existing hours to 6am to 9pm each day.  If both applications were granted there would be an overlap in the trading hours for both traders.  It was agreed that there should only be one trader on site, being the existing trader and comments will be passed onto the Borough Council.

Councillor Mrs Critchlow has written regarding grass cutting schedule and enclosed a copy of the minutes of a meeting held on 5 October for information.

It was agreed that it was not clear the times and locations of cutting and whilst the County Council have overall responsibility, which areas are delegated to the Borough Council.  Councillor Taylor offered to make some further enquiries and it was agreed that a meeting be held with the Officer at the County Council with overall responsibility.

Derbyshire County Council have received complaints that the white line recently marked in the square in Whitehough is not having the desired effect with vehicles still parking on it.  The County Council have advised that they can mark out a ‘Keep Clear’ test next to the line and are seeking comments.  It was agreed that this marking should go ahead.

The Clerk was asked to notify the Borough Council that the last 3 green box collections have not taken place on Bowden Lane.

Complaints have been passed on to the County Council about the amount of surface water on the highway at Hall Hill following the recent re-surfacing work.

Complaints have been received about the slippy surface on the footpath outside the former Post Office in Townend and the Clean Team were asked to clean them.  They have responded that they are unable to do this as the land is in private ownership.

10/257            Matters arising from the above Minutes

The Clerk was asked to write to Derbyshire County Council regarding a recent cycle event that started and finished at Chapel Leisure Centre to report the bad organisation, the blocking of roads around the school by cycle event users vehicles, lack of communication and cycles returning late with no lights.

Concern was expressed about the large unsightly containers on the frontage of Lomas Distribution in Townend and the fact that enforcement action can not be taken to remove them.  It was agreed that the Chairman and Chairman of the Regeneration Partnership should ask for a meeting with the owners to seek a resolution.

A discussion took place regarding the recommendation the Amenities Committee made in respect of funding the solar light.

Councillor Mrs Young proposed and Councillor S Young seconded that the solar light should be purchased for the Memorial Park as outlined in the Amenities Committee minutes of 17 November 2009.

RESOLVED:  That the solar light be purchased and funded in line with the Amenities Committee recommendation.

The Clerk reported that an application can be taken forward for LEADER funding for the refurbishment of the War Memorial.  It was noted that this is a Listed Monument and permission would need to be sought.   It is proposed that gas lights be added and at this stage it is uncertain if they were an original feature and further investigation is required.

Councillor Bayirli left the meeting at 20.40 hours.

10/258            Outside Bodies

Councillor Norton and the Clerk attended the Site Users meeting at Chapel High School.

Members were circulated with minutes of the Friends of the Memorial Park meeting held on 2 November 2009.

Notes from the Friends of Chapel Station meeting were circulated.

The Chairman and Councillor Mrs Young attended the Public Inquiry in respect of the licensing of vehicles to use the Old Coal Yard off Midland Road, Chapel-en-le-Frith.  An interim permission has been granted pending relocation to other premises and an agreement was reached over the permitted hours for maintenance work.

10/259            Town Hall

At present the Citizens Advice Bureau is only available to patients of the Thornbrook Doctors Surgery in Chapel-en-le-Frith as funding comes direct from the PCT.  To extend the service to all residents the CAB have advised that they would be willing to run an additional surgery at the Town Hall, but would have difficulty in paying the current hiring fee and are seeking agreement in principle for a reduce fee.  After discussion it was agreed that the fee for a 2 hour session should be £16.00.

Councillor Clarey declared an interest as he is employed by the PCT.

10/260            Parks and Open Spaces

It was agreed that the Amenities Committee should be asked to look at extending the path re-surfacing in the Memorial Park when setting budgets.

10/261            Correspondence

A letter has been received from a resident suggesting that the names of those who lost their lives in the 1939 – 45 conflict from the Parish should be included on the War Memorial on the Market Place.  The letter asks if this can be done by public subscription and advising that they would be willing to make a donation of £500 in this respect.

A letter has been received from a resident thanking members of the Council for arranging the 11am ceremony at the War Memorial on Remembrance Sunday and asking that it becomes a permanent event.  The Clerk was asked to pass this onto the British Legion for consideration.

10/262            Schedule of Accounts presented for payment

The Clerk submitted a list of accounts for which cheques numbered 005601 to 005623 amounting to £8,506.66 has been drawn.

A meeting of the Town Hall Committee was arranged for 19 January 2010 at 7.30pm.

10/221                        Declarations of Interest

Councillor Mrs Bayirli declared an interest in Police matters as she is employed by Derbyshire Constabulary.

Councillor F P Harrison declared an interest as a member of the Chapel-en-le-Frith branch of the Royal British Legion.

10/222            Police Matters 

The Police are looking to start the Pub Watch scheme up again before Christmas.

There were a large number of complaints about the vehicles parked around Chapel High School by the competitors of a recent cycle race.  Some vehicles were removed and parking tickets were issued.

It was reported that there were no calls for service in Chapel-en-le-Frith on Halloween.

There have been complaints about cars causing a noise nuisance in the Shoulder of Mutton Car Park and this will be addressed in the Pub Watch scheme.

Residents of Bowden Lane are disappointed that the Police appear to have failed to resolve the parking problems at the junction of Bowden Lane and Hayfield Road.

10/223            Open Forum

The Chairman of the Friends of the Memorial Park Group attended the meeting having already circulated details of the proposed Interpretation Board and Bandstand project.

It was agreed that the Bandstand project should be discussed in detail at the Amenities Committee.

The script for the Interpretation Board was agreed with minor amendments to the wording.

10/224            Highways, Public Footpaths and Public Services

The Clerk was asked to report the following paths to the Clean Team:

-          path from Market Street to the Primary School by the Methodist Church

-          path from Long Lane to Manchester Road

It was reported that the dog fouling team from the Staffordshire Moorlands/High Peak Alliance have been patrolling paths that have a high level of dog fouling.

It was agreed that the issue of roads being resurfaced and then dug up by utilities for planned maintenance should be an agenda item for the next County Council Liaison meeting.

It was reported that the lorries accessing the Old Coal Yard along Midland Road were still a problem.

10/228            Matters arising from the above Minutes

Derbyshire County Council have confirmed that the following action will be taken on points raised at the last full council meeting:

- report of skidding has been passed to our Laboratory for investigation

- loose chippings sign has now been removed

- damaged street nameplate has been reported to HPBC who maintain these signs

- and the puffin crossing and traffic lights have been reported to Traffic Signal Maintenance Section.

The residents of Bowden Lane are considering an alternative site for a grit bin.

High Peak Borough Council have now appointed a dedicated Planning Officer to resolve the Mirey Meadow planning issues.

The Clerk was asked to check if the vehicle traffic count had taken place in Dove Holes.

It was agreed that the Planning Committee would seek further clarification about the traffic management plan for the proposed work at the Martinside reservoir.

Councillor Mrs Armstrong joined the meeting at 20.15 hours.

The Clerk was asked to thank the Enforcement Officer at the Borough Council for his prompt action over recent planning issues.

The bench in memory of Jay Cameron is now in place in the Memorial Park.

10/229            Outside Bodies

The grass cutting schedule was raised at the recent County Council Liaison Meeting and they confirmed that is currently under review.

The Chairman reported back on the Central Area Group meeting.

Members were asked to feedback any issues relating to the Leisure Centre before the Joint Users Meeting on 11 November 2009.

10/230            DALC Circulars

Members were reminded that they need to confirm attendance at the Power of Well Being training course at the Town Hall on Monday 16 November.

10/231            Allotment Sites

The Chairman of the Amenities Committee reported that has received feedback from the Borough Council regarding the Federal Mogul site and Courses Allotments.  Federal Mogul are hoping to consult locally on their proposals for the site before Christmas and the indications are that an agreement can be reached regarding the allotment land and possibly an extension to the existing site.

Councillor Mrs Batterbee arrived at 20.35 hours.

10/232            Correspondence

High Peak Borough Council has begun a consultation period on the Corporate Plan priorities for the coming year and all members have had a copy of the document to complete.

A copy of the Government response to the House of Commons Communities and Local Government Committee Report ‘ Market failure? – can the traditional markets survive’ has been received.

A request has been received from the Chapel-en-le-Frith Army Cadets for a grant to assist with the costs of an expedition to Nepal that 2 cadets from the detachment have been selected.  It was agreed that the F & GP Committee should consider this application.

A request has been received for a grant from Chapel-en-le-Frith Junior Football Club to assist with the hire of facilities for matches and training.  It was agreed that this application be referred to the Leisure Bursary Fund.

10/196            Police Matters

PC DePee advised members that Sgt Tim Barlow has been appointed as the new Safer Neighbourhood Sergeant for Chapel-en-le-Frith.

New profiles were agreed at the recent Safer Neighbourhood meeting and issues on Thornbrook Road will be addressed again.

Prior to Halloween PC DePee and PCSO Shaw will visit all the Schools to talk to children.

The Police were asked to look at parking on Manchester Road which obscures the sight lines when leaving Long Lane and cars parked on the footpath at the top of Bowden Lane.

Ward members have received complaints about young people gathering at the small play area on South Head Drive, Chapel-en-le-Frith on Friday evenings and causing a disturbance.

10/197            Open Forum

The Chairman introduced Mike Green, who is Head of Development Services across High Peak and Staffordshire Moorlands and is the appointed liaison officer in the Alliance Senior Management Team with the Parish Council.

Mike explained that he will be acting as a contact point and asked that all communication was channelled through the Clerk of the Council.

He has had a walkabout in Chapel-en-le-Frith and taken on board some outstanding issues.

He is happy to attend meetings and give advice and has 2 training sessions on Householders Permitted Development and General Planning issues which he can present to members and it was agreed that a date will be arranged for this. 

Planning Case Officers will be available to come out to discuss applications that are of local interest and in the future there will be more emphasis in committee reports of the Parish Councils view, given their local knowledge.

Planning publicity is currently under review and the neighbourhood notification scheme will be widened.  Members can remove planning notices once a decision has been agreed on a planning application and it was suggested that householders also be encouraged to remove the notices after a decision.

There are currently no proposals to change the mechanism for members of the public to view planning applications.

Members requested information about Conservation Areas as they have been advised that there are different restrictions in Whitehough and Chapel-en-le-Frith.

The cost of advice prior to submission of applications was discussed and it was noted that this only applies to commercial applications and that the cost is negligible in relation to many other Local Authorities.

10/198            Highways, Public Footpaths and Public Services

Details of No Waiting and Limited Waiting Restriction have been received from Derbyshire County Council in respect of new Orders.

A request has been made by the residents of Bowden Lane for a grit bin and Derbyshire County Council have advised that they would be agreeable to placing a bin at the turning circle or on land at 22 Bowden Lane. A further site will be submitted for consideration.

Derbyshire County Council have advised that the road at Rushup Edge will be closed from 23 November to 4 December to facilitate carriageway reconstruction.

The Clerk was asked to bring the following to the attention of Derbyshire County Council:

-          Street Lamp out opposite Fosters Flowers

-          Grooves in the road on the Ferodo Roundabout

-          Loose chippings sign needs removing on Burrfields

-          Street name sign damaged on Forresters Way when the crash barrier was installed.

It was reported that a plaque has been unveiled on Eccles Pike by the National Trust in memory of Mr Sugden and it was suggested to the National Trust that they look at improving the car parking.  It was noted that the land at Eccles Pike was donated to the National Trust by Mrs Spencer and this should be recognised in some way.

Ward members indicated that they are concerned that the highway at Mirey Meadow will not be brought up to an adoptable standard and it was noted that the Borough Council are currently looking at the issue.

10/204            Matters arising from the above Minutes

The date for the visit to the CCTV monitoring room has been changed to 12 November 2009 at 6pm

Derbyshire County Council have advised that they are going to do some vehicle counts on Station Road in Dove Holes to see if the number of vehicles has increased since the traffic lights have been installed.  Once the data is collected they will decide if there are benefits to introducing a One Way system.

The Clerk was asked to report to Derbyshire County Council that the sensors on the traffic lights in Townend and Dove Holes may need some adjustment.

Councillor FP Harrison advised that he is not able to attend the Parish and Town Council Liaison meeting with Derbyshire County Council and the Chairman asked that if any other members are interested in attending to let him know.

The Clerk confirmed that no further details have been received regarding the adoption of telephone boxes following the initial expression of interest.

Councillor Norton declared an interest in Planning Application 10/184 and confirmed that the footpath referred to is not on the definitive footpath map.

Concern was expressed that the Council has previously passed a resolution to accept that the arrangements for Remembrance Sunday remain unchanged this year and that an alternative event would not be organised in an attempt to avoid division in the community and that the Chairman should not be laying a personal wreath on Remembrance Sunday at a time when the Church service was taking place.  The Chairman explained that his act of remembrance was personal and that he was not doing it as Chairman of the Council.  Some members however, felt that he was well known as Chairman of the Council and that members of the public would not distinguish between a civic role and a personal role.  Some members felt that it was an act of provocation and that having voted in favour of the resolution he should abide by it and attend the Church service and lay the Council wreath as usual.  The Chairman indicated that he was not willing to do this.

The Remembrance Sunday Working Group had agreed that the Parish Council wreath should be laid by the Chairman at the War Memorial on the Market Place at 11am on 11 November 2009.  However, the Clerk advised that they had gone outside their brief in suggesting this and that a decision was required regarding the laying of the wreath.

Councillor Mrs Batterbee proposed that the Parish Council wreath should be laid at the War Memorial on the Market Place on Remembrance Sunday, following the Church service organised by the Parish Church and British Legion as it has been in previous years.  Councillor Smith seconded the motion.

4 votes were cast in favour, 1 against and 6 abstentions.

RESOLVED:  That Councillor Mrs Batterbee will lay the Parish Council wreath at the War Memorial on Remembrance Sunday following the Church Service as in previous years.

The Working Party had made a proposal for an alternative Civic Service for 2010 and the Clerk advised that she had taken advice from DALC on the matter which was whilst there is an active local British Legion Branch they have the responsibility for making the arrangements for Remembrance Sunday.  In the event that this is not the case the Parish Council can step in and make arrangements.

A letter has been received from the local branch of the Royal British Legion asking if the Council wishes them to take back the arranging of the Remembrance Sunday parade in future years and Councillor Clarey proposed and Councillor McCarthy seconded that whilst there is an active British Legion local branch the Parish Council should not play a role in the event.

A vote was cast with 9 members in favour and 2 abstentions.

RESOLVED:  That whilst there is an active local British Legion branch the Parish Council will not organise the Remembrance Sunday parade.

The Working Party made suggestions for fund raising events for the British Legion and proposals to undertake some work on the War Memorial which will be progressed.

As the Town Hall Committee was not quorate the Chairman spoke to each of the items on the Town Hall Committee minutes which were all ratified.

10/205            Outside Bodies

Minutes of the High Peak and Hope Valley Community Rail Partnership Meeting on 15 September 2009 are attached to these minutes.

The Chairman of the Regeneration Partnership gave a report on the agreed expenditure for the coming year:

-          5 Tourist Information Signs

-          Reprint of 10,000 copies of the Town Trail

-          May Day 2010

-          Advertisement in the Peak District Guide

-          Repairs to the Touch screen at the Hearse House.

The Chairman and Chairman of Planning attended the recent Joint Core Strategy Meeting.  It was noted that none of the sites that the Parish Council had put forward for future development were on the consultation literature and this was pointed out at the meeting.  Following the consultation period a draft plan will be published in January 2010 for further consultation.

10/206            DALC Circulars

Members have been circulated with DALC Circular 49 covering the future policing of events.

10/207            Parks and Open Spaces

A request has been made for permission to erect a stone bench in the Memorial Park in memory of Jay Cameron, which was agreed to.

A letter has been received from Friends of Chapel Memorial Park seeking funding for the Bandstand project which would be recouped from any grant funding obtained towards the project.  It was agreed that the Chairman of the Friends of the Park Group be invited to speak at the next Open Forum before a decision is made.

Members were concerned about the level of young people misbehaving at the recent band concert and that in future the services of a PCSO should be requested.

10/208            Correspondence

High Peak Borough Council have advised that Councillors Mark Gadd and David Lomax have been nominated as Chairman of the Central Area Forum 2009-10.  The Council has one vote and it was agreed that this be cast in favour of Councillor Lomax.

The Clerk was asked to advise that Borough Council that two members had felt unable to vote as they did no know either of the candidates and there was no personal submission from either candidate with the voting information.

A letter has been received from the Poppy Appeal Organiser inviting all members to this years Parade.

A letter has been received from the Girl Guides expressing their concern over the arrangements for Remembrance Sunday this year and the need to make changes for the better in future years.
