CHAPEL-EN-LE-FRITH PARISH COUNCIL MINUTES OF THE EXTRAORDINARY MEETING HELD ON 5 JANUARY 2010 Meeting Held: Tuesday 12 January 2010 in the Annexe of the Town Hall, Chapel-en-le-Frith Present: Councillor VGB Martin in the Chair. Clarey, F P Harrison, M Harrison. McCarthy, Norton, Smith, Mrs A S Young and S Young. In Attendance: Mrs SE Stockdale - Clerk of the Council Apologies were received from Councillors Mrs S Armstrong, Mrs Batterbee, Mrs Bayirli and Brookfield. 10/281 Schedule of Accounts presented for payment The Clerk submitted a list of accounts for which cheques numbered 005624 to 005638 amounting to £12,138.28 has been drawn. RESOLVED: That the cheques be signed and the accounts to which they relate be paid. There being no further business the Chairman declared the meeting closed at 20.15 hours CHAIRMAN

CHAPEL-EN-LE-FRITH PARISH COUNCIL MINUTES OF THE ORDINARY MEETING HELD ON 1 DECEMBER 2009 Meeting Held: Tuesday 1 December 2009 in the Annexe of the Town Hall, Chapel-en-le-Frith Present: Councillor VGB Martin in the Chair. Mrs S Armstrong, Mrs Batterbee, Mrs Bayirli, Clarey, F P Harrison, McCarthy, Smith, Mrs A S Young and S Young. In Attendance: Mrs SE Stockdale - Clerk of the Council Councillor B Taylor Rev Leach said prayers. At the commencement of the meeting there was one member of the press present. Apologies were received from Councillors Brookfield, M Harrison and Norton. The Chairman extended Christmas wishes to members. The Chairman expressed disappointment at the poor turnout to recent events and in particular the Power of Well Being training Course and the CCTV visit. It was agreed that dates for meetings wherever possible will be set in advance for the full year in May 2010. 10/250 Declarations of Interest Councillor Bayirli declared an interest as she is employed by Derbyshire Constabulary. 10/251 Police Matters Residents have reported receiving unsolicited telephone calls from a company undertaking a survey on burglar alarms. This has been the subject of recent ringmaster messages and residents are asked to pass details onto Trading Standards should it be found that companies are trying to mislead. The Chairman thanked PCSO Julie Shaw for arranging the recent visit to the CCTV monitoring unit. There has been a recent arrest in connection with money laundering and drug dealing and a further drug related arrest in Chapel-en-le-Frith. It was reported that the anti social behaviour problems on Thornbrook Road had moved behind the Londis store and this is being monitored. Pupils at Chapel Primary School have taken part in Community Speed Watch and the High School are also to take part. There are two new Special Constables who will be aligned to the Safer Neighbourhood Teams. 10/252 Open Forum None. 10/253 Highways, Public Footpaths and Public Services Derbyshire County Council have advised that they have not been able to complete data counts at the Dove Holes traffic lights yet, due to existing Department of Transport commitments. Derbyshire County Council advise that the A624 at the junction of the B6062 at New Smithy will be closed from 11 January 2010 to 22 February 2010 for bridge refurbishment work. Work will also take place at the junction of Eccles Road and Station Road from 1 – 3 February 2010. A street trading consent is being sought from High Peak Borough Council for the Dove Holes lay-by to sell food each day from 4pm to 11pm from a mobile unit. This will be in addition to the existing consent for a mobile unit selling food from 6am – 4pm each day. Following consultation with the existing trader an application has been received to extend the existing hours to 6am to 9pm each day. If both applications were granted there would be an overlap in the trading hours for both traders. It was agreed that there should only be one trader on site, being the existing trader and comments will be passed onto the Borough Council. Councillor Mrs Critchlow has written regarding grass cutting schedule and enclosed a copy of the minutes of a meeting held on 5 October for information. It was agreed that it was not clear the times and locations of cutting and whilst the County Council have overall responsibility, which areas are delegated to the Borough Council. Councillor Taylor offered to make some further enquiries and it was agreed that a meeting be held with the Officer at the County Council with overall responsibility. Derbyshire County Council have received complaints that the white line recently marked in the square in Whitehough is not having the desired effect with vehicles still parking on it. The County Council have advised that they can mark out a ‘Keep Clear’ test next to the line and are seeking comments. It was agreed that this marking should go ahead. The Clerk was asked to notify the Borough Council that the last 3 green box collections have not taken place on Bowden Lane. Complaints have been passed on to the County Council about the amount of surface water on the highway at Hall Hill following the recent re-surfacing work. Complaints have been received about the slippy surface on the footpath outside the former Post Office in Townend and the Clean Team were asked to clean them. They have responded that they are unable to do this as the land is in private ownership. 10/254 Minutes of the Full Council Meeting held on 3 November 2009 Minutes numbered 10/221 to 10/235 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/255 Minutes of the Planning Meeting held on 4 November 2009 Minutes numbered 10/236 to 10/242 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/256 Minutes of the Amenities Committee held on 17 November 2009 Minutes numbered 10/243 to 10/249 were presented. Apologies were received from Councillor Clarey. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/257 Matters arising from the above Minutes The Clerk was asked to write to Derbyshire County Council regarding a recent cycle event that started and finished at Chapel Leisure Centre to report the bad organisation, the blocking of roads around the school by cycle event users vehicles, lack of communication and cycles returning late with no lights. Concern was expressed about the large unsightly containers on the frontage of Lomas Distribution in Townend and the fact that enforcement action can not be taken to remove them. It was agreed that the Chairman and Chairman of the Regeneration Partnership should ask for a meeting with the owners to seek a resolution. A discussion took place regarding the recommendation the Amenities Committee made in respect of funding the solar light. Councillor Mrs Young proposed and Councillor S Young seconded that the solar light should be purchased for the Memorial Park as outlined in the Amenities Committee minutes of 17 November 2009. RESOLVED: That the solar light be purchased and funded in line with the Amenities Committee recommendation. The Clerk reported that an application can be taken forward for LEADER funding for the refurbishment of the War Memorial. It was noted that this is a Listed Monument and permission would need to be sought. It is proposed that gas lights be added and at this stage it is uncertain if they were an original feature and further investigation is required. Councillor Bayirli left the meeting at 20.40 hours. 10/258 Outside Bodies Councillor Norton and the Clerk attended the Site Users meeting at Chapel High School. Members were circulated with minutes of the Friends of the Memorial Park meeting held on 2 November 2009. Notes from the Friends of Chapel Station meeting were circulated. The Chairman and Councillor Mrs Young attended the Public Inquiry in respect of the licensing of vehicles to use the Old Coal Yard off Midland Road, Chapel-en-le-Frith. An interim permission has been granted pending relocation to other premises and an agreement was reached over the permitted hours for maintenance work. 10/259 Town Hall At present the Citizens Advice Bureau is only available to patients of the Thornbrook Doctors Surgery in Chapel-en-le-Frith as funding comes direct from the PCT. To extend the service to all residents the CAB have advised that they would be willing to run an additional surgery at the Town Hall, but would have difficulty in paying the current hiring fee and are seeking agreement in principle for a reduce fee. After discussion it was agreed that the fee for a 2 hour session should be £16.00. Councillor Clarey declared an interest as he is employed by the PCT. 10/260 Parks and Open Spaces It was agreed that the Amenities Committee should be asked to look at extending the path re-surfacing in the Memorial Park when setting budgets. 10/261 Correspondence A letter has been received from a resident suggesting that the names of those who lost their lives in the 1939 – 45 conflict from the Parish should be included on the War Memorial on the Market Place. The letter asks if this can be done by public subscription and advising that they would be willing to make a donation of £500 in this respect. A letter has been received from a resident thanking members of the Council for arranging the 11am ceremony at the War Memorial on Remembrance Sunday and asking that it becomes a permanent event. The Clerk was asked to pass this onto the British Legion for consideration. 10/262 Schedule of Accounts presented for payment The Clerk submitted a list of accounts for which cheques numbered 005601 to 005623 amounting to £8,506.66 has been drawn. RESOLVED: That the cheques be signed and the accounts to which they relate be paid. 10/263 Any Other Business A meeting of the Town Hall Committee was arranged for 19 January 2010 at 7.30pm. The following budget meetings were arranged: 12 January 2010 Amenities Committee – 6.30pm Town Hall Committee – 7.30pm F & FP Committee – 8.15pm The Amenities Committee were asked to look at the possibility of floodlighting the Market Place for Christmas tree lighting next year. Apologies were received from Councillors Brookfield and Smith. 10/221 Declarations of Interest Councillor Mrs Bayirli declared an interest in Police matters as she is employed by Derbyshire Constabulary. Councillor F P Harrison declared an interest as a member of the Chapel-en-le-Frith branch of the Royal British Legion. 10/222 Police Matters The Police are looking to start the Pub Watch scheme up again before Christmas. There were a large number of complaints about the vehicles parked around Chapel High School by the competitors of a recent cycle race. Some vehicles were removed and parking tickets were issued. It was reported that there were no calls for service in Chapel-en-le-Frith on Halloween. There have been complaints about cars causing a noise nuisance in the Shoulder of Mutton Car Park and this will be addressed in the Pub Watch scheme. Residents of Bowden Lane are disappointed that the Police appear to have failed to resolve the parking problems at the junction of Bowden Lane and Hayfield Road. 10/223 Open Forum The Chairman of the Friends of the Memorial Park Group attended the meeting having already circulated details of the proposed Interpretation Board and Bandstand project. It was agreed that the Bandstand project should be discussed in detail at the Amenities Committee. The script for the Interpretation Board was agreed with minor amendments to the wording. 10/224 Highways, Public Footpaths and Public Services The Clerk was asked to report the following paths to the Clean Team: - path from Market Street to the Primary School by the Methodist Church - path from Long Lane to Manchester Road It was reported that the dog fouling team from the Staffordshire Moorlands/High Peak Alliance have been patrolling paths that have a high level of dog fouling. It was agreed that the issue of roads being resurfaced and then dug up by utilities for planned maintenance should be an agenda item for the next County Council Liaison meeting. It was reported that the lorries accessing the Old Coal Yard along Midland Road were still a problem. 10/225 Minutes of the Full Council Meeting held on 6 October 2009 Minutes numbered 10/195 to 10/211 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/228 Matters arising from the above Minutes Derbyshire County Council have confirmed that the following action will be taken on points raised at the last full council meeting: - report of skidding has been passed to our Laboratory for investigation - loose chippings sign has now been removed - damaged street nameplate has been reported to HPBC who maintain these signs - and the puffin crossing and traffic lights have been reported to Traffic Signal Maintenance Section. The residents of Bowden Lane are considering an alternative site for a grit bin. High Peak Borough Council have now appointed a dedicated Planning Officer to resolve the Mirey Meadow planning issues. The Clerk was asked to check if the vehicle traffic count had taken place in Dove Holes. It was agreed that the Planning Committee would seek further clarification about the traffic management plan for the proposed work at the Martinside reservoir. Councillor Mrs Armstrong joined the meeting at 20.15 hours. The Clerk was asked to thank the Enforcement Officer at the Borough Council for his prompt action over recent planning issues. The bench in memory of Jay Cameron is now in place in the Memorial Park. 10/229 Outside Bodies The grass cutting schedule was raised at the recent County Council Liaison Meeting and they confirmed that is currently under review. The Chairman reported back on the Central Area Group meeting. Members were asked to feedback any issues relating to the Leisure Centre before the Joint Users Meeting on 11 November 2009. 10/230 DALC Circulars Members were reminded that they need to confirm attendance at the Power of Well Being training course at the Town Hall on Monday 16 November. 10/231 Allotment Sites The Chairman of the Amenities Committee reported that has received feedback from the Borough Council regarding the Federal Mogul site and Courses Allotments. Federal Mogul are hoping to consult locally on their proposals for the site before Christmas and the indications are that an agreement can be reached regarding the allotment land and possibly an extension to the existing site. Councillor Mrs Batterbee arrived at 20.35 hours. 10/232 Correspondence High Peak Borough Council has begun a consultation period on the Corporate Plan priorities for the coming year and all members have had a copy of the document to complete. A copy of the Government response to the House of Commons Communities and Local Government Committee Report ‘ Market failure? – can the traditional markets survive’ has been received. A request has been received from the Chapel-en-le-Frith Army Cadets for a grant to assist with the costs of an expedition to Nepal that 2 cadets from the detachment have been selected. It was agreed that the F & GP Committee should consider this application. A request has been received for a grant from Chapel-en-le-Frith Junior Football Club to assist with the hire of facilities for matches and training. It was agreed that this application be referred to the Leisure Bursary Fund. 10/233 Schedule of Accounts presented for payment The Clerk submitted a list of accounts for which cheques numbered 005576 to 005600 amounting to £9,766.49 has been drawn. RESOLVED: That the cheques be signed and the accounts to which they relate be paid. 10/234 Any Other Business The Clerk was asked to contact Councillor Critchlow as there have been problems contacting her through the County Council website. Members felt it would be useful if the County Councillors attended Parish Council meetings but it was stressed that they would only be able to take part in the Open Forum. Apologies were received from Councillors Brookfield and M Harrison. 10/195 Declarations of Interest Councillor Mrs Bayirli declared an interest in Police matters as she is employed by Derbyshire Constabulary. Councillor F P Harrison declared an interest as a member of the Chapel-en-le-Frith branch of the Royal British Legion. 10/196 Police Matters PC DePee advised members that Sgt Tim Barlow has been appointed as the new Safer Neighbourhood Sergeant for Chapel-en-le-Frith. New profiles were agreed at the recent Safer Neighbourhood meeting and issues on Thornbrook Road will be addressed again. Prior to Halloween PC DePee and PCSO Shaw will visit all the Schools to talk to children. The Police were asked to look at parking on Manchester Road which obscures the sight lines when leaving Long Lane and cars parked on the footpath at the top of Bowden Lane. Ward members have received complaints about young people gathering at the small play area on South Head Drive, Chapel-en-le-Frith on Friday evenings and causing a disturbance. 10/197 Open Forum The Chairman introduced Mike Green, who is Head of Development Services across High Peak and Staffordshire Moorlands and is the appointed liaison officer in the Alliance Senior Management Team with the Parish Council. Mike explained that he will be acting as a contact point and asked that all communication was channelled through the Clerk of the Council. He has had a walkabout in Chapel-en-le-Frith and taken on board some outstanding issues. He is happy to attend meetings and give advice and has 2 training sessions on Householders Permitted Development and General Planning issues which he can present to members and it was agreed that a date will be arranged for this. Planning Case Officers will be available to come out to discuss applications that are of local interest and in the future there will be more emphasis in committee reports of the Parish Councils view, given their local knowledge. Planning publicity is currently under review and the neighbourhood notification scheme will be widened. Members can remove planning notices once a decision has been agreed on a planning application and it was suggested that householders also be encouraged to remove the notices after a decision. There are currently no proposals to change the mechanism for members of the public to view planning applications. Members requested information about Conservation Areas as they have been advised that there are different restrictions in Whitehough and Chapel-en-le-Frith. The cost of advice prior to submission of applications was discussed and it was noted that this only applies to commercial applications and that the cost is negligible in relation to many other Local Authorities. 10/198 Highways, Public Footpaths and Public Services Details of No Waiting and Limited Waiting Restriction have been received from Derbyshire County Council in respect of new Orders. A request has been made by the residents of Bowden Lane for a grit bin and Derbyshire County Council have advised that they would be agreeable to placing a bin at the turning circle or on land at 22 Bowden Lane. A further site will be submitted for consideration. Derbyshire County Council have advised that the road at Rushup Edge will be closed from 23 November to 4 December to facilitate carriageway reconstruction. The Clerk was asked to bring the following to the attention of Derbyshire County Council: - Street Lamp out opposite Fosters Flowers - Grooves in the road on the Ferodo Roundabout - Loose chippings sign needs removing on Burrfields - Street name sign damaged on Forresters Way when the crash barrier was installed. It was reported that a plaque has been unveiled on Eccles Pike by the National Trust in memory of Mr Sugden and it was suggested to the National Trust that they look at improving the car parking. It was noted that the land at Eccles Pike was donated to the National Trust by Mrs Spencer and this should be recognised in some way. Ward members indicated that they are concerned that the highway at Mirey Meadow will not be brought up to an adoptable standard and it was noted that the Borough Council are currently looking at the issue. 10/199 Minutes of the Full Council Meeting held on 1 September 2009 Minutes numbered 10/156 to 10/170 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/201 Minutes of the Remembrance Sunday Working Group held on 8 September 2009 Minutes numbered 10/178 to 10/179 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/202 Minutes of the Town Hall Committee held on 29 September 2009 Minutes numbered 10/188 to 10/193 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/203 Minutes of the Community Awards Committee held on 2 October 2009 Minutes numbered 10/194 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/204 Matters arising from the above Minutes The date for the visit to the CCTV monitoring room has been changed to 12 November 2009 at 6pm Derbyshire County Council have advised that they are going to do some vehicle counts on Station Road in Dove Holes to see if the number of vehicles has increased since the traffic lights have been installed. Once the data is collected they will decide if there are benefits to introducing a One Way system. The Clerk was asked to report to Derbyshire County Council that the sensors on the traffic lights in Townend and Dove Holes may need some adjustment. Councillor FP Harrison advised that he is not able to attend the Parish and Town Council Liaison meeting with Derbyshire County Council and the Chairman asked that if any other members are interested in attending to let him know. The Clerk confirmed that no further details have been received regarding the adoption of telephone boxes following the initial expression of interest. Councillor Norton declared an interest in Planning Application 10/184 and confirmed that the footpath referred to is not on the definitive footpath map. Concern was expressed that the Council has previously passed a resolution to accept that the arrangements for Remembrance Sunday remain unchanged this year and that an alternative event would not be organised in an attempt to avoid division in the community and that the Chairman should not be laying a personal wreath on Remembrance Sunday at a time when the Church service was taking place. The Chairman explained that his act of remembrance was personal and that he was not doing it as Chairman of the Council. Some members however, felt that he was well known as Chairman of the Council and that members of the public would not distinguish between a civic role and a personal role. Some members felt that it was an act of provocation and that having voted in favour of the resolution he should abide by it and attend the Church service and lay the Council wreath as usual. The Chairman indicated that he was not willing to do this. The Remembrance Sunday Working Group had agreed that the Parish Council wreath should be laid by the Chairman at the War Memorial on the Market Place at 11am on 11 November 2009. However, the Clerk advised that they had gone outside their brief in suggesting this and that a decision was required regarding the laying of the wreath. Councillor Mrs Batterbee proposed that the Parish Council wreath should be laid at the War Memorial on the Market Place on Remembrance Sunday, following the Church service organised by the Parish Church and British Legion as it has been in previous years. Councillor Smith seconded the motion. 4 votes were cast in favour, 1 against and 6 abstentions. RESOLVED: That Councillor Mrs Batterbee will lay the Parish Council wreath at the War Memorial on Remembrance Sunday following the Church Service as in previous years. The Working Party had made a proposal for an alternative Civic Service for 2010 and the Clerk advised that she had taken advice from DALC on the matter which was whilst there is an active local British Legion Branch they have the responsibility for making the arrangements for Remembrance Sunday. In the event that this is not the case the Parish Council can step in and make arrangements. A letter has been received from the local branch of the Royal British Legion asking if the Council wishes them to take back the arranging of the Remembrance Sunday parade in future years and Councillor Clarey proposed and Councillor McCarthy seconded that whilst there is an active British Legion local branch the Parish Council should not play a role in the event. A vote was cast with 9 members in favour and 2 abstentions. RESOLVED: That whilst there is an active local British Legion branch the Parish Council will not organise the Remembrance Sunday parade. The Working Party made suggestions for fund raising events for the British Legion and proposals to undertake some work on the War Memorial which will be progressed. As the Town Hall Committee was not quorate the Chairman spoke to each of the items on the Town Hall Committee minutes which were all ratified. 10/205 Outside Bodies Minutes of the High Peak and Hope Valley Community Rail Partnership Meeting on 15 September 2009 are attached to these minutes. The Chairman of the Regeneration Partnership gave a report on the agreed expenditure for the coming year: - 5 Tourist Information Signs - Reprint of 10,000 copies of the Town Trail - May Day 2010 - Advertisement in the Peak District Guide - Repairs to the Touch screen at the Hearse House. The Chairman and Chairman of Planning attended the recent Joint Core Strategy Meeting. It was noted that none of the sites that the Parish Council had put forward for future development were on the consultation literature and this was pointed out at the meeting. Following the consultation period a draft plan will be published in January 2010 for further consultation. 10/206 DALC Circulars Members have been circulated with DALC Circular 49 covering the future policing of events. 10/207 Parks and Open Spaces A request has been made for permission to erect a stone bench in the Memorial Park in memory of Jay Cameron, which was agreed to. A letter has been received from Friends of Chapel Memorial Park seeking funding for the Bandstand project which would be recouped from any grant funding obtained towards the project. It was agreed that the Chairman of the Friends of the Park Group be invited to speak at the next Open Forum before a decision is made. Members were concerned about the level of young people misbehaving at the recent band concert and that in future the services of a PCSO should be requested. 10/208 Correspondence High Peak Borough Council have advised that Councillors Mark Gadd and David Lomax have been nominated as Chairman of the Central Area Forum 2009-10. The Council has one vote and it was agreed that this be cast in favour of Councillor Lomax. The Clerk was asked to advise that Borough Council that two members had felt unable to vote as they did no know either of the candidates and there was no personal submission from either candidate with the voting information. A letter has been received from the Poppy Appeal Organiser inviting all members to this years Parade. CHAPEL-EN-LE-FRITH PARISH COUNCIL MINUTES OF THE ORDINARY MEETING HELD ON 1 SEPTEMBER 2009 Meeting Held: Tuesday 1 September 2009 in the Annexe of the Town Hall, Chapel-en-le-Frith Present: Councillor VGB Martin in the Chair. At the commencement of the meeting there was one member of the press present. Apologies were received from Councillors Mrs Batterbee, Brookfield, Clarey, FP Harrison, Norton and Smith. PC DePee and PCSO Shaw 10/156 Declarations of Interest None. 10/157 Police Matters PCSO Julie Shaw has asked members to suggest a couple of suitable dates for the visit to the CCTV monitoring room. It was agreed that a visit be arranged for either 23 September or 29 September at 7.30pm. 10/158 Open Forum There were no members of the public wishing to speak. 10/159 Highways, Public Footpaths and Public Services Derbyshire County Council have advised that Bagshaw Lane will be closed between 14 – 18 September to allow for carriageway drainage works. Derbyshire County Council have advised that Whitehough Head Lane, from Crossings Road to Whitehough will be closed between 26 October and 9 November to allow for carriageway resurfacing. High Peak Borough Council have advised that BT are looking to close the public telephone boxes in Combs, Dove Holes and Whitehough and have asked if the Parish Council wish to adopt either of these boxes. It was agreed that an interest be expressed in adopting all the three boxes and interest will be sought from the local communities. A letter has been received from a resident in Whitehough asking that the Council adopt the telephone box and offering to set up a Friends Group to look after the upkeep of the box. Derbyshire County Council have submitted plans of proposed road markings in Whitehough. It was agreed that a single white line should be marked by the notice board and telephone box. A request has been received from a resident in Dove Holes asking that the first past of Station Road be made ‘One Way’. The comments will be passed onto Derbyshire County Council. It was also noted that the County Council advised that they would monitor the situation on Station Road following concerns when the traffic lights were installed. A view will now be sought from them. A letter has been received from the Blackbrook Conservation Society advising that they have complained about the barrier on footpath 171 in Whitehough on the tramway as it is not wide enough to allow a motorised disabled buggy to pass. The Clerk will pass the complaint onto the Rights of Way Officer at Derbyshire County Council. Complaints regarding the green box collection and wheelie bin collections on Bowden Lane have been taken up with High Peak Borough Council by the Ward Members. Part of the problems with the collections is due to vehicles causing an obstruction at the top of Bowden Lane and it was agreed that the Clerk should bring the matter up with the Police and Parking Enforcement Wardens as a joint approach to tackle the problem is required. 10/160 Minutes of the Full Council Meeting held on 4 August 2009 Minutes numbered 10/126 to 10/144 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/163 Matters arising from the above Minutes Derbyshire Public Transport Unit have taken on board the comments made by members regarding an additional bus stop near the Kings Arms and have asked that members would reconsider their decision as they have received a large number of requests from people having to use the Market Place Post Office following the closure of the Town End Post Office. Members felt that a compromise would be to provide an extra bus stop by the Chemist for people who would otherwise have to walk up the hill and leave the stop on the other side of the road at Cromwell House as the walk to it is on the flat. The Public consultation on the Needham Recreation Ground Play Area will take place on 2 September. High Peak Borough Council have agreed not to sell the grassed area by the bus shelter on Hayfield Road East, provided that the Parish Council take over the maintenance of the area. A formal letter is awaited from High Peak Borough Council in this respect. The Vice Chairman reported that he has met with the County Councillor and Traffic Officers with the owner of Longdendale Nursery to discuss possible signage options. The work on the crash barrier by the Fallow Deer will commence on 7 September 2009. The Digital TV road show will visit again later in the year. The Chairman advised that he was giving £25 of bulbs from his allowance to the Friends of Chapel Station and Friends of the Memorial Park. High Peak Borough Council have advised that there is a backlog of planning notifications to be sent out. The Borough Council members updated members on planning application 0254 and suggested that some public consultation would be appropriate given the proposed number of vehicle movements on the site. Discussions are ongoing with Federal Mogul regarding the acquisition of the Courses allotment site. It was agreed that a joint Interpretation Board and Notice Board should be taken forward as a joint project with the Friends of the Memorial Park. United Utilities have not responded to the letter send regarding the drainage problems in the Memorial Park and the Clerk will chase this up and ask for a meeting on site. 10/164 Remembrance Sunday The Chairman reported that the meeting had taken place with the Parochial Church Council, Vicar, Church Wardens, British Legion and British Legion Chaplin and that the request for a 9.45am start for the Remembrance Sunday Service had been rejected. Members were disappointed and hoped that public opinion would press for a change in future years. It was agreed unanimously that as the Parish Church and British Legion have sent out joint invitations for the Remembrance Day Service and Parade this year that the Council would not take part in any organisation or have any responsibility for the day in 2009. A meeting of the Working Group was arranged for 8 September 2009 at 7.30pm to discuss arrangements for 2010. It was agreed that a formal Press Release be issued. A meeting of the Remembrance Sunday Working Group was arranged for 8 September 2009 at 7.30pm 10/165 Parks and Open Spaces Councillor Mrs Armstrong asked that her thanks be passed onto the Park Manager for his help in the judging of the Dove Holes Garden Competition. 10/166 Allotments The allotment competition prizes will be presented at the October Full Council Meeting. 10/167 Correspondence High Peak Borough Council have advised details of Core Strategy Public Exhibitions, one of which will be on the Town Hall forecourt on 3 September 2009. 10/168 Schedule of Accounts presented for payment The Clerk submitted a list of accounts for which cheques numbered 005524 to 005545 amounting to £14,141.74 has been drawn. CHAPEL-EN-LE-FRITH PARISH COUNCIL MINUTES OF THE ORDINARY MEETING HELD ON 4 AUGUST 2009 Meeting Held: Tuesday 4 August 2009 in the Annexe of the Town Hall, Chapel-en-le-Frith Present: Councillor VGB Martin in the Chair. Brookfield, Clarey, FP Harrison, M Harrison, McCarthy, Mrs A S Young and S Young. In Attendance: Mrs SE Stockdale - Clerk of the Council Councillor Mrs T Critchlow Rev Leach said prayers. Apologies were received from Councillors Mrs Armstrong, Mrs Batterbee, Mrs Bayirli, Norton and Smith. At the commencement of the meeting there were 8 members of the public and 1 member of the press present. Prior to the commencement of the meeting the Chairman reminded members that all questions should be made through the Chairman and asked that members raised their hands should they wish to speak. The Chairman then went on the read the following statement to members: Mr Derek Eley, the President of the Chapel-en-le-Frith Branch of the Royal British Legion and Councillor Guy Martin, Chairman of Chapel-en-le-Frith Parish Council, with the goodwill of the Rev N Bralesford jointly ask the members of the Parochial Church Council of St Thomas Becket to agree the Remembrance Day Service commences at 9.45pm and be completed in time for the 11am silence and laying of wreaths to take place on the Market Place. We ask for this in an endeavour to bring all persons of our town together in an Act of Remembrance, recognising that there are many different faiths and beliefs represented. In the general interest it is felt that dividing the town is not the best way forward and we appreciate concessions will be made by all parties. 10/126 Declarations of Interest Councillor F P Harrison declared an interest as a member of the Royal British Legion and indicated that this was not a prejudicial interest. 10/127 Police Matters There were no Police matters. 10/128 Open Forum Mr J Brook made the following statement: I wish to speak in support of the Parish Councils decision to hold a short ceremony and service at the war Memorial on Remembrance Sunday, to include the two minutes silence at 11.00. The reasons behind this decision are well known, the original request coming from members of the public who felt it was more appropriate to have the Church service earlier to enable a fully inclusive 11.00 ceremony at the War Memorial, and the subsequent views expressed from the Parish Meeting through the Parish Council to the Parochial Church Council. The Parochial Church Councils apparent refusal to even consider that request is very saddening. Their response published in the Buxton Advertiser which made no reference to it, but seemed to refer to changes that were never requested, left the Parish Council in my view, with no alternative. The Parish Council, who were given the task of organising the Civic part of the Remembrance day activities by The Royal British Legion, are beholden to the whole people of Chapel, and the views expressed at the properly convened Parish Meeting. I think everyone would agree that the current situation is unsustainable, and cannot continue, even if for this year the undesirable compromise is unavoidable. The allegiance of everyone involved is being split. However, the strength of public opinion is such that, in my view, the Parochial Church council should urgently reconsider their position. I therefore support the Parish Council in their efforts to comply with the majority’s wishes. Rev N Bralesford spoke and acknowledged that the joint request from the Chairman and President of the Royal British Legion will be considered at a Parochial Church Council meeting on 27 August 2009, to which the Chairman and Clerk together with the President of the Royal British Legion are invited. The Rev Bralesford went on to explain that the times of Church services are fixed by the PCC and therefore they have to sanction any changes to agreed times of services at Church. The reasons why the PCC has so far declined the requests that the service time be brought forward on Remembrance Sunday are in the public domain, by means of a joint letter issued by the Parish Church and Royal British Legion, in a letter to the Buxton Advertiser and by means of invitations to the 2009 Remembrance Day Service and Parade. This will be the official event on Remembrance Sunday with anything organised by the Council being deemed to be a breakaway event. The Remembrance Day Service has been held at 10.30pm for the last 88 years and this will be the 89th year. The Church are arranging a Remembrance poster which will be displayed in the Remembrance corner at the Parish Church. Rev Bralesford noted that the Remembrance Sunday service in Dove Holes is held in the afternoon. Members commented that they were not trying to organise a breakaway event and strongly object to this suggestion. The Council who represent the whole community are merely trying organise Remembrance Sunday to allow the whole community to come together at 11am for a public Act of Remembrance at the Memorial on Chapel Market Place. It was questioned whether the PCC and British Legion have the powers to say they are organising the ‘Official’ event. It was noted that the service book that is currently being used was partially funded with a grant of £120 by the Parish Council and is the official Royal British Legion Remembrance Sunday order of service. It was pointed out the Rev Bralesford that his suggestion in his letter to the Buxton Advertiser, that the reasons why there were so many people assembled last year at 11am on the Market Place was parents waiting to collect children who were taking part, was incorrect as all uniformed organisations march back to Thornbrook Road, where the parade is dismissed. Rev Bralesford was asked to take back to the PCC the thoughts of residents who the Council represent and that the majority of residents class the War Memorial on Chapel Market Place as the official War Memorial. This Memorial has the names of all who fought in the 1st World War and an inscription to those who fought in 2nd World War. People also wish to pay their respects to those who have lost their lives in subsequent conflicts together with remembering those who are currently serving in Afghanistan and Iraq. If the British Legion have concerns that the collection on the day is under threat, there is an opportunity to collect from the people in Church and on the Market Place if a compromise situation is reached. Councillor Mrs Critchlow outlined the format of Remembrance Sunday in Tideswell where she lives, which offers both a Church Service and communal Act of Remembrance at the village War Memorial and expressed her sadness that a compromise had not been reached in Chapel-en-le-Frith to allow a similar event. 10/129 Remembrance Sunday The Chairman suspended Standing Orders to allow item 10 on the agenda to be taken directly after the Open Forum. The Clerk had received Notice of the following Motion signed by Councillors McCarthy, Smith, FP Harrison and Mrs Bayirli: Remembrance Sunday That, in the view of new information, and out of respect for the now stated wishes of the Chapel-en-le-Frith Branch of the British Legion and to avoid division and conflict on a day when the whole community should be united in Remembrance, the Minutes of the Council Meeting which determined that there should be a Ceremony at the War Memorial at 11am on Remembrance Sunday 2009, and which was a decision made at the Parish Council meeting held on 7th day of July 2009, be and is revoked and that the Council now agrees to arrange a parade on behalf of the Legion which will arrive at the Parish Church in time for Morning Service on Remembrance Sunday and to conduct a public Act of Remembrance at the War Memorial in the Market Place when such Church Service is concluded. The Clerk was asked if Standing Orders allowed the debate to be re-opened before a 6 month period had elapsed and she indicated that the subject would be allowed to be discussed by Special Resolution and advice from DALC had been sought, which was in view of the sensitive and important nature of the debate and the introduction of new information, it would be better that the issued was resolved. Members were concerned that the British Legion appear to be changing their minds and the Chairman advised that the President of the British Legion did have the full support of the local branch and was authorised to sign the joint statement. A request has been received from a resident that a letter he has received from the Imperial War Museum be read out to members. The letter indicates that in any community there may be a number of War Memorials and no one should be classed as an official Memorial. A copy letter addressed to the Vicar has been received from the Guides who feel that they have been put in a difficult position having to choose between two events on Remembrance Sunday following the official invitation from the Parish Church. Councillor Smith in his absence has written to the Chairman to express his feelings that the wishes of the British Legion be respected and that the whole community should be united in remembrance. Councillor Mrs Young read out a letter that she had written to the working party expressing her views in that this was the first time in 30 years that she had received an invitation from the Church to the Remembrance Day service and that she took exception to remarks publicly made by the Parish Church and felt that they have not taken into account the strength of feeling in the town. It was agreed that Remembrance Sunday will be an agenda item at the next Full Council meeting to enable a report to be given following the PCC Meeting on 27 August. 10/130 Highways, Public Footpaths and Public Services Councillor Mrs Critchlow advised that an extra bus stop is being considered near the Kings Arms Public House. The recent problems with the Tramway being dug up in Whitehough by United Utilities is hopefully being resolved. Derbyshire County Council agreed a temporary closure for the work to be carried out and any responsibility regarding the conservation of the site was with United Utilities, which was agreed. United Utilities have been in discussion with English Heritage and will under their guidance undertake reinstatement works. The Vice Chairman asked for a meeting with the County Councillor to discuss signage problems at Blackbrook Nursery. Councillor Mrs Critchlow agreed that she would obtain details of the maintenance routine for grass cutting and path maintenance. She was made aware of a dangerous stile on the path near Marsh Hall Lane. The No Through Road sign has now been erected on Brookside Road and the Clerk was asked to request a similar sign for Longmeade Drive. Derbyshire County Council have confirmed that there are no proposals for work at the following locations at present, but they will be re-inspected later in the year to identify any patching works. Junction of Park View Drive and Rowton Grange Road, Chapel-en-le-Frith Junction of Eccles Road and Midland Road, Chapel-en-le-Frith. A request was made for more parking warden time in Chapel-en-le-Frith. The Chief Executive of High Peak Borough Council has indicated the work is taking place to finalise the adoption of the Mirey Meadow development site. The Digital TV advice van was very well attended and a further visit will be arranged. It was noted that the frequency of future High Peak Borough Council Development Control Meetings has not yet been agreed. High Peak Borough Council have confirmed that the small car park off Hayfield Road is still in the ownership of Barratts. The Community Awards Committee will be presenting further details for approval on the proposed Community Award scheme. 10/137 Outside Bodies A copy of the notes from the High Peak and Hope Valley Community Rail Partnership on 30 June 2009 are attached to these minutes. 10/138 Circulars and Correspondence It was agreed that Councillor Mrs T Critchlow be nominated for DALC President in the forthcoming elections. It was agreed that Councillor Martin and Councillor FP Harrison attend the Derbyshire County Council Liaison meeting on 22 October 2009 and that maintenance of paths and grass cutting schedules be put forward as an agenda item. 10/139 Parks and Open Spaces The Amenities Committee will be considering the provision of new play equipment at Needham Recreation Ground and public consultation at the meeting on 6 August 2009. Members commented on the excellent street planters this year. The Vice Chairman advised that consultation is taking place regarding the disposal by High Peak Borough Council of a piece of land on Hayfield Road West. 10/140 Allotments The Amenities Committee will be considering allotment provision at the meeting on 6 August 2009. The Chairman and Park Manager will judge the allotments shortly for the annual allotment competition. 10/141 Correspondence High Peak Borough Council are seeking nominations for the Chairman and Vice Chairman for the Central Area Forum by 11 September 2009. It was agreed that Councillor Smith be nominated for both positions. A letter has been received from the Leader of High Peak Borough Council following the recent Meet and Greet event with the newly appointed senior management team. The Clerk advised that a senior management team member has been allocated as the point of contact for issues in the Parish and he has indicated that he would like to come along to a Council meeting to introduce himself. It was agreed that he be invited to the full council meeting in October. Chinley, Buxworth and Brownside Parish Council have forwarded a copy letter that they have sent to High Peak Borough Council requesting that consideration be made to setting up a one stop shop in the Central Area when Chinley Offices closes. Mrs Armstrong, Mrs Batterbee, Mrs Bayirli, Brookfield , Clarey, F P Harrison, M Harrison, McCarthy, Norton, Smith, Mrs A S Young and S Young. In Attendance: Mrs SE Stockdale - Clerk of the Council Councillor Mrs T Critchlow Inspector T Lewis PCSO J Shaw Rev Leach said prayers. At the commencement of the meeting there was 1 member of the press present and 19 members of the public. 10/93 Declarations of Interest Councillor Bayirli declared an interest as she is employed by Derbyshire Constabulary. 10/94 Police Matters Inspector Lewis advised members that the policy of Derbyshire Constabulary relating to the policing of community events like carnivals was changing to fall in line with other authorities and APTCO agreements. The Police will still be represented at community events to deal with crime and disorder, but will no longer provide officers for traffic management. The Police are willing to work closely with event organisers to advise on traffic management, but the responsibility for the safe passage of processions lies with the organisers. Councillor Mrs Armstrong arrived at 7.40pm. Remembrance Sunday will be the exception. Members expressed concern that this action could potentially put young people involved in events at risk and ultimately some events may not take place. It was noted that Derbyshire Police set an above inflation precept and are now withdrawing services. The new Safer Neighbourhood Policing priorities are:- Speeding within local areas and a Community Speed Watch scheme is being launched. The Police are working with High Peak Community Housing to provide some events for young people during the summer holidays and are looking for funding in this respect. Inspector Lewis advised that Officers will be stationed in the CCTV monitoring centre every Friday and Saturday night until the end of August. Members noted with concern that the CCTV monitoring is to be merged with Staffordshire Moorlands. 10/95 Open Forum Mrs Rosie Bateman addressed the council on the issue of allotment provision, asking that consideration be given to re-opening the Leys allotments as there are currently 15 people on the Courses waiting list. It was agreed that the Amenities Committee should consider this at their next meeting. Simon Axford addressed the council to express his concern at the withdrawal of Police support for the Dove Holes carnival, given that the route is on the busy A6. He stressed that he would need to know the level of support from the Police for the 2010 carnival and noted that they would still support the Remembrance Sunday procession as before. Alison Young addressed the council on behalf of the Chapel-en-le-Frith Carnival Committee, regarding the future Police support for the event. Currently the Carnival Committee has 7 members of which 5 are able to assist on Carnival Day. Already extensive road closures are put in place in conjunction with the Police with the problem areas being the Jolly Carter, Sheffield Road, Morrison’s roundabout, Long Lane and Rowton Grange Road. With over 150 participants at the carnival there are serious risk management issues if the committee have to marshall the event themselves. There is a real likelihood that the event may not be able to take place. Members noted that community events are a positive thing for communities and should not be lost. The Chairman indicated that the 5 Parish/Town Councils in the central area of High Peak are making strong representations to the Derbyshire Constabulary and seeking an urgent meeting. Mr Rob Stoddard addressed the council to express his views and the views of the local Scouts on the future format for Remembrance Sunday. Mr Stoddard indicated that he was a local resident who is also an ex serviceman and an atheist and he asked the council to move the act of Remembrance on Remembrance Sunday at 11am to the Memorial on Chapel Market Place. He stated that he was not trying to remove the Church service and was not wishing to compromise any funds collected by the British Legion on the day. However, he felt that the Memorial on the Market Place was the focal point for the community and therefore the Act of Remembrance should take place there at 11am to allow all members of the community with a faith or no faith to remember together. He felt that a small minority were refusing to make a compromise which would be in the interests of the majority. The Scouts commented that they do not wish to detract from the extreme importance of Remembrance Sunday and fully respect the work of the British Legion and hope that the Parish Church would agree to a compromise to enable the whole community unite at the Memorial on the Market Place at 11am. Mr Chris Hughes addressed the Council on behalf of disabled personnel and said that he would like to the Remembrance Sunday service shared between the three churches in Chapel-en-le-Frith. Mr Mike Crompton address the council to ask for support in asking High Peak Borough Council to devolve the budget for dog fouling in the central area to the Town and Parish Council to administer. Councillor Critchlow advised members that she is Cabinet Member at Derbyshire County Council for Young People, following her successful re-election and would welcome comments relating to young peoples services in the Parish. She is currently looking at the level of services provided. She advised that she has money for funding projects as a member and would welcome any applications. 10/96 Remembrance Sunday The Chairman suspended Standing Orders to move this item on the agenda. The Chairman provided members with written details of the meetings that have taken place with the Vicar, Church Wardens and Parochial Church Council regarding Remembrance Sunday. The comments from the Public Meeting and correspondence have been shared with the Parish Church, where the overwhelming view is that the Act of Remembrance should take place on the Market Place at 11am to allow the community to join together as a whole. The Parish Church have been asked to consider moving the time of the service to allow this to happen and following very lengthy discussions with them to come to a compromise they have refused the request. Members were asked for their thoughts on the issue and felt that we should fall in line with the Country as a whole meeting at 11am on the Market Place. It was noted that there were 84 people waiting on the Market Place at 11 am in 2008. A local charity have indicated that they would look at underwriting any loss in collection the British Legion may suffer if the service was moved from the Parish Church. Members were concerned that the community should not be split and every effort should be taken to see if a compromise could be reached. The Chairman advised that the Parish Church had indicated that they were not prepared to negotiate any changes. Councillor Mrs Young proposed and Councillor Mrs Armstrong seconded that a Civic Service be arranged for Chapel-en-le-Frith Market Place starting with a procession at 10.45am on Remembrance Sunday to allow the Service and Act of Remembrance to take place on the Market Place, Chapel-en-le-Frith at 11am and too allow all organisations and denominations and those with no faith to take part together. It was noted that the items relating to South Head Drive, Chapel-en-le-Frith are still the responsibility of the developer. The Borough Council will be asked to take up the matter of the uneven path with the developer as it is a safety issue. Members are invited to comment on the Derbyshire Local Transport Plan by 31 July 2009. Derbyshire County Council have looked at the footway by the Dog Inn and confirmed that they would not be able to improve the situation due to other constraints. The Clerk was asked to report damage to the public telephone box at the bottom of Burrfields Road to BT. The Clerk was asked to obtain the schedule of grass cutting for the Parish from Derbyshire County Council. It was noted that the mowing of the grass verges by High Peak Borough Council on estate roads has been substandard again this year. Derbyshire County Council will be asked to complete a speedy repair of the kerbstone on the Market Place and it was suggested that it could be altered to allow wheelchairs to access the pavement and public toilets. The Regeneration Committee were asked to look at the public toilet redevelopment as a complaint has been received about the concrete plinth that the railings are fixed to as it is not in keeping with the Conservation Area. The Clerk was asked to write to Derbyshire County to confirm the maintenance schedule for paths listed on the Definitive map as the path from the Jolly Carter to Sheffield Road is not being maintained adequately. Members asked the County Councillor to expedite the lighting of the new traffic refuge on Manchester Road as it is currently a hazard. The Clerk was asked to find out when the Borough Council will be erecting the new street sign on Brookside Road. 10/98 Minutes of the Full Council Meeting held on 2 June 2009 Minutes numbered 10/55 to 10/74 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/99 Minutes of the Planning Meeting held on 9 & 30 June 2009 Minutes numbered 10/77 to 10/83 and 10/86 to 10/92 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/100 Minutes of the Community Awards Committee held on 9 June 2009 Minutes numbered 10/75 to 10/76 were presented. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/101 Minutes of the F & GP Committee held on 30 June 2009 Minutes numbered 10/84 to 10/85 were presented. Councillor Mrs A Young declared an interest in the Methodist Church application and did leave the room whilst it was being considered. RESOLVED: That the Chairman be authorised to sign the Minutes as being a true and correct record. 10/102 Matters arising from the above Minutes High Peak Borough Council have advised that Planning Permission will be required for the 5 tourist signs following a change in the regulations in 2007. Members have been circulated with a copy of the proposed Housing Needs Survey in respect of Affordable Housing. The Head of Housing at High Peak Borough Council/Staffordshire Moorlands has been asked to fund the Affordable Housing Survey. Members have been circulated with Leisure Centre Accounts and Summer Programme following the Joint Facilities Meeting on 4 June 2009. The Leisure Centre reported that there has been a slight increase in fees, which remain in line with High Peak Borough Council Leisure Centres. The design for the crash barrier at the Fallow Deer has now been approved and should be in place soon. The Clerk was asked to write a letter of thanks for the greenhouse that has recently been donated to the Council. The Town Hall Committee were asked to look at possible additional ventilation in the Annexe room. The Carnival organisers are to make a donation to cover the cost of repairs to the Memorial Park following carnival day. It was agreed that the number of vehicles in future on the park should be limited in future to essential vehicles only. The Clerk was asked to write to the Park Keeper and his staff to pass on the favourable comments that have been received about the standard of work and helpfulness. Councillor Norton indicated that he was not in agreement with the purchasing of uniforms for the Ladies Choir and felt that groups should purchase their own equipment. Councillor FP Harrison and Councillor Mrs Young declared an interest in this item. It was agreed that better financial information could be requested from some organisations in future. 10/103 Outside Bodies Members have been circulated with a copy of the Friends of the Memorial Park minutes from their last 2 meetings. It was agreed that the Chairman of the Friends of the Park be invited to the next Amenities Committee to discuss possible projects. The Regeneration Partnership are currently considering 5 projects: 5 tourist signs Work on the Mirey Meadow Footpath Touchscreen repairs Resurfacing the Town Hall frontage Reprinting the Old Town Trail The Chairman and Vice Chairman have attended a course on the Power of Well Being and all members were encouraged to attend the training when it comes to High Peak. 10/104 Parks and Open Spaces A letter of thanks has been received from the Chairman of Dove Holes Village Group thanking the Park Manager and his staff for the work they have undertaken at Dove Holes, together with the hanging baskets provided this year. The Clerk will write to United Utilities regarding the problems with the drain backing up into the Memorial Park. It was agreed that 3 further dog fouling/litter signs be ordered for the Memorial Park gates. 10/105 Allotments It was agreed that the Amenities Committee should look at re-opening the Leys allotments. 10/106 Correspondence The National Park Peak Parishes Day will be held on 19 September 2009 at Ilam Hall Youth Hostel. Councillors Martin, FP Harrison and Mrs Armstrong indicated that they wished to attend. A copy of the East Midlands Regional Assembly Plan consultation received. A letter of thanks has been received from the organisers of the Dove Holes Jazz Festival in respect of the grant made to the event. 10/107 Schedule of Accounts presented for payment The Clerk submitted a list of accounts for which cheques numbered 005464 to 005504 amounting to £25,788.26 has been drawn. RESOLVED: That the cheques be signed and the accounts to which they relate be paid. There being no further business the Chairman declared the meeting closed at 22.10hours. CHAIRMAN
