CHAPEL-EN-LE-FRITH PARISH COUNCIL MINUTES OF THE MEETING OF THE PARISH PLANNING COMMITTEE Meeting Held: Tuesday 26th January 2010 in the Annexe of the Town Hall, Chapel-en-le-Frith Present: Councillor Mrs Young in the Chair Councillors Martin, Smith, FP Harrison, Norton, Mrs Armstrong Apologies: Councillors Mrs Batterbee, McCarthy, Brookfield, Clarey Absent: Councillor Mrs Bayirli 10/293 Plenary Powers Applications seeking Planning Permission or Approval to carry out development at locations within the Parish. The Committee considered in turn nine applications to carry out developments within the Parish and it was RESOLVED: That the following comments be sent to the relevant Planning Authority. 0567 Mrs Audra Barratt 07.01.10 Owlgreave Farm, Combs Road, Chapel-en-le-Frith Retrospective application for the retention of a storage area for purposes of straw bedding, cows and sheep. Members are concerned about the number of retrospective planning applications associated with Owlgreave Farm and have advised that an investigation takes place into the reasons behind the rapidly growing complex of buildings. Members also questioned whether the land was being farmed by the applicant and the need for this building. Members would like to request a site visit. 0750 Mr Scott Moss 13.01.10 Brookfold, Delabrook Farm, The Wash, Chapel-en-le-Frith Retrospective planning application for change of use from existing barn to form dwelling. Members objected to this application as it would set an unfortunate president for other holiday homes within the Borough. The conditions for the original application for a holiday home were clearly set out and stated that the barn be used for no other purpose. Members would also like to submit their comments for the original application for the conversion of the barn. Members strongly objected to this development for several reasons
0007 Mrs Wendy Stoodley 19.01.10 Barn adjacent to Parkfield Lodge, Bankhall Drive, Chapel-en-le-Frith Conversion of barn to form 1 dwelling. Members objected to this application due to the proposed dwelling being situated in the open countryside. The barn is relatively new and not in a state of disrepair, and given the surroundings, Members feel this should continue to be used as a barn. An application for a new dwelling would not be given in this location. 0746 0747 Mr Kevin Shone 22.01.10 Lydgate Farm, Eccles Road, Chapel-en-le-Frith Re-siting of wind turbine. To place turbine further away from building and with better wind speed averages, as advised by consultants Eagle Power Ltd. Members have requested a site visit to assess the visual impact the re-siting of the turbine will have on the landscape, given its close proximity to Eccles Pike and surrounding National Trust land. 0757 Mrs Lucy Wallace 26.01.10 6 Thornbrook Road, Chapel-en-le-Frith Change of use from an A1 shop to an A3 café, and change of shop signage No objection. Members thought this was a sensitive conversion. 0028 Mrs Lucy Wallace 26.01.10 6 Thornbrook Road, Chapel-en-le-Frith Change of use from an A1 shop to an A3 café, and change of shop signage No objection. Members thought this was a sensitive conversion. 0003 Mr Alan Cawthorn 26.01.10 Blythe House Hospice, Chapel-en-le-Frith 1st floor addition and enclosing of courtyard. Councillors Mrs Young and FP Harrison declared a personal, non-prejudicial interest. No objection providing there are no adverse affects to 1 Crossings Meadow. 0027 Mr Darren Kay 26.01.10 37 Manchester Road, Chapel-en-le-Frith Retention of shop front. No objection. The shop front is an improvement to its previous untidy look and no residents have complained about the change in materials or design. Peak Park 0032 Mr Dennis Green 22.01.10 Rookery House Farm, Blackbrook, Chapel-en-le-Frith Proposed agricultural building for the housing of farm machinery to replace the existing dilapidated building. No objection but Members insisted that the roof material be approved green sheeting to blend in with the surrounding areas. 10/294 Appeals HPK/2009/0442, 1 The Meadows, Dove Holes. 10/295 Notifications None 10/296 Conservation Areas Councillor Smith will ask Joanne Brooks if the ‘salon’ for sale on Market Street can be advertised as being eligible for restoration grants in the Estate Agents blurb. 10/297 Public Footpaths After the severe weather conditions, many of the footpaths have been left with an abundance of grit covering them. The section of the Linear Footpath which runs through the field onto Park Road is in need of restoration work as the track had disappeared. 10/298 Correspondence The unacceptable state of the recycling sites in Chapel-en-le-Frith has brought complaints from both Councillors and residents. The sites are overflowing and are an eye-sore. Due to the cancelled bin collections in Chapel due to the weather, residents have also been dumping house-hold waste at these points. A new ‘disaster recovery’ plan needs to be devised to limit the effects felt after such events in the future. High Peak Borough Council have been made aware of the problem and are looking for a solution. The small carpark on Hayfield Road has been inspected by DCC and a report detailing the works to be carried out has been forwarded onto the developer. We will be kept informed of any further developments. 10/299 Any Other Business A date has been requested for a training session on the computerisation of planning applications. Councillor Mrs Young is going to advertise the next training session with Mike Green in the Buxton Advertiser so members of the public can attend. This will take place at the next meeting of the Planning Committee on February 16th at 7.30pm. There being no further business the Chairman declared the meeting closed at 8.40pm CHAIRMAN |

The Committee considered in turn eleven applications to carry out developments within the Parish and it was RESOLVED: That the following comments be sent to the relevant Planning Authority. 0660 Mr Lee Forman 17.12.09 The Hanging Gate, Cockyard, Chapel-en-le-Frith Conversion of Church Mission to staff annexe No objection, although the plans do state that the roof material will be Welsh Blue Slate whereas the written material states that a blue/black tile similar to Blue Slate will be used. 0699 Mr Robert McDermot 17.12.09 Moult Farm, Eccles Fold, Whitehough Raising of existing concrete/timber fences on land to allow adjacent hedge to be removed. No objection in principal, but Members would prefer the hedge to remain as the location is open countryside. 0708 Mr Anthony O’Riley 17.12.09 6 Spencer Road, Chapel-en-le-Frith Proposed first floor side extension. Members had no objection to an extension in this location, but did not favour a two-storey addition being added onto a dormer bungalow. It is not aesthetically pleasing and members would prefer the development to continue in the dormer style. 0554 Mr Stuart Wilson 22.12.09 Ridge Barn, Ridge Farm, Cowlow Lane, Combs, Chapel-en-le-Frith Conversion of derelict barn building to form new 4bedroom dwelling. Cllr Mrs Young declared an interest. Members were in favour of the conversion as the imaginative design was sensitive to the surrounding area, and the profile of the building has been retained. There is also adequate parking. However, members were concerned about the large number of velex windows being added onto the western side of the building and would like these to be reduced. 0710 Mr P Armett 22.12.09 1 The Meadows, Dove Holes Extension to existing garage No objection as the garage has been reduced in size from the previous application. 0726 Mr M and J Byatte 06.01.10 The Cottage, Owlgreave Farm, Combs Road, Combs Removal of Condition from approved planning application in 1985 No objection, members were sympathetic to the reasons given for the removal of the condition. 0707 Mr M Byatte 06.01.10 The Cottage, Owlgreave Farm, Combs Road, Combs Removal of condition 4 on HPK/2001/0119, to allow the ménage to be used in the evenings and winter months. Members were not unanimous in their decision and there was a split vote, with Chairman having the casting vote. Although members could understand the reasons for the addition of the lights to the ménage and the importance of this to the business, they were extremely concerned about the light pollution this would cause in the open countryside. Members have requested that strict conditions be included to control and limit the time the lights could be used, and that this should be closely monitored. CON/2009/0030 08.12.09 DCC Chapel-en-le-Frith Primary School Warmbrook Road, Chapel-en-le-Frith Erection of new children’s centre and school reception between existing school buildings with glazed link connecting corridor between buildings Councillors Clarey and Smith both declared an interest. No objection. Peak Park 1039 Mr Terry Hallam 03.12.09 Pear Tree Cottage, Bagshaw, Chapel-en-le-Frith Replace existing single storey with new single storey gable extension. No objection, members thought the proposed development was an improvement to the design of the building. 1001 Mr and Mrs Moorcroft 03.12.09 Bolt Edge Farm, Dove Holes New 2.0m x 1.0m diameter LPG storage tank with solid boarded timber enclosure fence. No objection. Peak Park Amended Plans 1007 Mr Daniel Hodgson 08.12.09 Ford House, Ford, Chapel-en-le-Frith Extension of house; partly 2 storey, part single No objection. Members would like to re-submit their previous comments and add that the double gable arrangement was an improvement to the design of the extension. No objection providing all materials match existing. Members thought the extension was aesthetically pleasing and would meet family needs. 10/273 Appeals None 10/274 Notifications Permission 0411 10/275 Conservation Areas A complaint has been received from a resident regarding new commercial signs that have been erected onto the gable end of Daily News. Mike Darling will be asked if planning permission is required. The PVC crates have been removed from outside Lomas Distribution. Due to overhanging trees and vehicles parked in the turning circle, the Glossop Community Transport bus cannot negotiate Bowden Lane. This matter will be reported to both the police and High Peak Borough Council. 10/276 Public Footpaths The footpath leading past the Shoulder of Mutton to the housing estate has still not been resurfaced. This will again be brought to the attention of the Borough Council on the next ‘walk-round’ High Peak Borough Council will be asked for an update on the actions taken to rectify the small car park on Hayfield Road. 10/277 Correspondence The following road closures have been received Cowlow Lane, Dove Holes, from 02.03.10 to 10.01.10 to facilitate carriageway resurfacing works A6 Chapel By-Pass from the junction with Bowden Lane to the junction with Buxton Road, from 22.03.10 to 27.03.10, between the hours of 1900hrs and 0700hrs to facilitate lining and studding works. Whitehough Head Lane, Chinley from the junction with Charley Lane to the junction with Hunters Green Close from 08.03.10 to 18.03.10, to facilitate carriageway resurfacing works. The Committee considered in turn six applications to carry out developments within the Parish and it was RESOLVED: That the following comments be sent to the relevant Planning Authority. 0590 Mr Malcolm Farrar 05.11.09 Riverside, Tunstead Milton, Whaley Bridge Two storey side extension to form new family room with bedroom over. Internal alterations to relocate kitchen and form new en-suite and dressing room. No objection. The design is well suited to the building and is sited away from immediate neighbours. 0611 Mr Martin Hubbard 05.11.09 Britannia House, 32 Buxton Rd, Dove Holes To remove existing signage and replace with new. No objection. The signs will have no adverse affect on nearby properties. 0622 Mr Pieter Platt 10.11.09 Stirling Facilities Management Ltd 87 Market St, Chapel-en-le-Frith Change of use to B1 No objection. The property has already been used for this purpose for some time with no adverse affects. It is also situated in an area of Chapel that is surrounded with businesses including shops and other offices. 0615 Mr Richard Butterworth 10.11.09 17 Market Place, Chapel-en-le-Frith Change of use from A3 (café) to A5 (takeaway) No objection. However the parking referred to in the application is public parking that is used by other businesses and residents. There is public parking nearby at Miry Meadow. 0636 Mrs Amanda Wickham 24.11.09 57 Beresford Ave, Chapel-en-le-Frith Two storey extension and new front porch No objection. The dwelling is set on a large plot of land and the extension would not affect neighbouring properties. Members thought the extension was aesthetically pleasing and would meet family needs. 10/266 Appeals None 10/267 Notifications Refused Peak Park 0774, 0775 10/268 Conservation Areas None 10/269 Public Footpaths None 10/270 Correspondence A reply has been received from Monica Gillespie from HPBC regarding the felling of the Birch Tree. The tree was felled due to root decay and a fungus infection. It would be incredibly hard to bring a successful prosecution against the builders who damaged the tree as a direct cause between the building works and the infection would need to be ‘proved beyond reasonable doubt’ as it would be a criminal case. This is not possible as the fungus may have already been present. HPBC have informed the site owner that a replacement tree is required and will persue this matter with the owner. HPBC have responded to the request to remove the vehicles that have been parked on Milton Lane, Tunstead Milton to say they are parked on private property and have no power to remove them unless the land owner reports the problem. The Committee considered in turn eleven applications to carry out developments within the Parish and it was RESOLVED: That the following comments be sent to the relevant Planning Authority. 0578 Mr and Mrs G Bevan 15.10.09 Higher Birches, Tunstead Milton, Whaley Bridge Resubmission of HPK/2009/0465 for single storey side extension Whilst Members now appreciate that the applicants earlier application had been to build in open countryside, they would like to submit the same comments as before. No objection. Members thought the extension enhanced the property. 0421 Mr and Mrs Longdon 16.10.09 Bowdenhay Mill, Bowden Lane, Chapel-en-le-Frith Demolish lean to extension, part demolish lean to storage building and replace with new offices. Remove existing concrete wall and planting area, dig out bank and re-grade parking area. Members applauded the movement of a large commercial business to an industrial estate. In order to protect residents amenity, members would like a condition to be included that would prohibit any trucks from being parked on the residential side of the estate. 0557 Mrs Audra Barratt 20.10.09 Owlgreave Stables, Owlgreave Farm, Combs Road, Chapel-en-le-Frith Planning application HPK/2002/0685. To allow lights to be used on the Menage. Members were not in favour of the original application for the ménage and feel the use of floodlights causes light pollution within the countryside. 0411 Chapel-en-le-Frith Parish Council 20.10.09 5 locations covering the ‘gateways’ to chapel Erect a tourist board at each location with inter-changeable events signs. All members declared an interest due to the applicant being the Parish Council and chose not to submit a comment. 0569 Mrs Puddick 22.10.09 Bowden Hall Cottage, Bowden Lane, Chapel-en-le-Frith Retain garage for domestic use, (renewal of temporary permission) No objection, provided the permission is only extended and not granted for a permanent structure. 0604 Dr Steve Peters 27.10.09 Newlyn Crossings Road, Chapel-en-le-Frith Extension to existing dwelling to provide 2 additional bedrooms with en-suite facilities and double height conservatory. Members thought the inclusion of a double height conservatory would affect neighbours on the adjacent housing estate, especially as it would contain a gallery. The extension appears incongruous in an area of small dwellings that are predominately bungalows, which will become overlooked from the gallery. For the above reasons members would like the site to be visited by the delegated officer. 0613 Mr Andrew Bartholomew 27.10.09 141 Manchester Road, Chapel-en-le-Frith Re-submission of application HPK/2009/0446, construction of 5 bedroom dwelling in the garden of 141 Manchester Road with new access to serve the existing house. As there has been no change to the size, scale or design to the proposed build, Members would like to re-submit their previous comments. No objection. The new house has an attractive design and will greatly improve the site, which is currently an uncultivated area of land. 0489 Mr Chris Halliwell 29.10.09 Mill Cottage, Tunstead Milton, Whaley Bridge Proposed works to remove solid plaster to internal walls to full perimeter of dwelling to an approx. height of 0.5m, reinstate plaster finishes with agreed hydraulic breathable renovating plaster. Emusion to finish all internal walls. Without advice from a conservation officer, Members were unable to comment. 0607 Mrs Angela Buttrill 29.10.09 Rowan Cottage, Bowling Green Lane, Chapel-en-le-Frith 2storey extension to provide new hallway and living room with bedroom and en-suite above. No objection. The addition enhances the existing house and fits in well with the surrounding area. 0584 0581 Mr Jonathon Holland 02.11.09 The Cottage, Chapel Milton, Chapel-en-le-Frith The construction of offices and workshops Demolition of existing builders workshop and storage buildings The new buildings will improve the look of the area and are visually attractive. They are a vast improvement to the buildings that are currently there. However, Members were concerned about the poor accessibility to the site, and asked that a condition should be included to prohibit the conversion to domestic dwellings as the application is for commercial purposes. 0628 Mr Jason Williams 02.11.09 114 Manchester Road, Chapel-en-le-Frith Replacement of existing wooden garage with a larger block and render construction in a similar position. No objection. The replacement of the garage will improve the look of the site. 10/237 Appeals None 10/238 Notifications Permission 0407, 0315, 0479, 0132 Refused 0465, 0371 10/239 Conservation Areas Due to illegal building works, a mature Birch Tree at the rear of Town End Post Office, from Quentin Road, has had to be felled as the roots had been severely damaged. Enforcement officers were informed at the time of the works and halted any further developments until the tree had been protected. Unfortunately, the damage had already been caused. HPBC will be made aware of this to in a view to enforcement action being carried out to those responsible. 10/240 Public Footpaths None 10/241 Correspondence An application has been received to erect a railway communications mast in Chapel-en-le-Frith. A copy of the letter will be sent to John Brooks, Friends of Chapel Station. DCC Environmental Services will be dealing with the hazardous garden at 4 Grange Park Avenue, Chapel-en-le-Frith. The cars stored on the verge at The Ceadars, Tunstead Milton does not become an enforcement action from HPBC. Julie Shaw has confirmed that it is only a police matter if the cars are parked on the highway. DCC will be informed of the problem. 10/242 Any Other Business Federal Mogul will be asked to inform the Planning Committee of any developments regarding the sale and redevelopment of their land. No objection. This is much more preferable to an empty building and members thought there was sufficient parking nearby to service the training rooms and office. Members thought the addition would improve the look of the site and blend in well with surrounding properties. Peak Park 0775 Mr B Colley 29.09.09 The Garden House, Chapel-en-le-Frith, High Peak Erection or an oak framed orangery No objection. The design has been sensitively created to blend in with the surrounding area. Councillor Mrs Bayirli left at 8pm 10/215 Appeals 0112 10/216 Notifications Permission 0254, 0229, 0413, 0434, 0271, 0292, 0381, 0274, 0359, 0377, 0291, 0017, 0275, 0133, Refusal 0358, 0429, 0112, 0446 10/217 Conservation Areas Eddie Willshaw has identified the forecourt of the Town Hall as an area which could be eligible for a HERS grant. The idea would be to pave the areas where people walk, so between the bollards to the front door and to flag a ‘footpath’ under the covered walkway to the offices and library. Bollards would be needed at the entrance to the walkway to prevent parking. 10/218 Public Footpaths Mike Green will report back on any actions that can be taken as a result from the ‘walk round’ with the Clerk and Chairman. The footpath that runs from Burrfields to Bowden Hall is overgrown. 10/219 Correspondence A new bus stop has been introduced on the south side of the road between the Chemist and Bowling Green Lane. It is for one direction only. An application for a Certificate of Lawfulness has been received from Mr Nigel Webb for existing use of land as a domestic garden and tennis court with attendant pavilion. No Councillor could confirm the use of the land for more than 10 years. 10/220 Any Other Business Mike Darling will be informed about the amount of vans parked in the garden at 4 Grange Park Avenue which is an eye saw. Andy Ellis will be informed about the large container at 1 Frith View which is in the garden. He will also be sent a letter regarding planning application HPK/2006/0143. The application to increase the number of vehicles that can be stored on land opposite The Ceadars, Milton Lane, Tunstead Milton was refused and now vehicles are being parked in the verge and on the edge of the highway. As this is a retrospective planning application, Members would prefer it if the height of the outbuilding was reduced. No objection. Members welcomed the new build on a section of in-fill land rather than on the outskirts of Chapel-en-le-Frith. 0486 Mr Mark Evans 15.09.09 47 Station Rd, Dove Holes, Buxton Construction of 4 houses (2 semi-detached houses) on Evans Yard, land adjacent to 47 station Rd, Dove Holes. No objection. Members thought this was a much improved design and the new houses, along with the increase in amenity space, would fit well with the surrounding area. 0466 JE Morten Ltd 16.09.09 JE Morten Ltd, Tunstead Milton, Whaley Bridge · New retaining wall to SE corner of yard and reinstate yard to its original ground level in this area · Excavate to form Level Yard and provide new concrete surface to NE section of existing yard. A temporary 10mph speed limit will be introduced on the A6, between Barmoor Clough roundabout and Dove Holes due to road marking refurbishment works. Network Rail has sent details of a proposed erection of a communications mask at Dove Holes Station. No objection. 10/150 Appeals None 10/151 Notifications None 10/152 Conservation Areas None 10/153 Public Footpaths The grass cutting on the Horsefair Estate has been completed to a poor standard with mounds of cut grass being left and scattered. Members appreciated that it is not HPBC policy to collect the grass but if this is to happen the frequency needs to be increased so that the amount of grass left behind is much smaller. Monica Gillespie has been made aware of the tree cutting at Morrisons. No action can be taken as the land is owned by Morrisons and there are no tree preservation orders in place. Monica has contacted Morrisons to give them advice on how to correctly prune and fell trees so that the result is more aesthetically pleasing. The stones on the tramway have been reinstated. 10/154 Correspondence Simon Tranter at DCC Highways will be sent copies of all the correspondence regarding the large agricultural vehicles using Eccles Road, as HPBC were unable to help as it was beyond their remit. A reply will be sent to Mr. David Mullholland regarding this matter informing him of the Parish Councils actions. On August 23rd the A6, from its junction with Barmorclough (A623) for a distance of 1.8km will be closed due to the renewal of overhead cables. The National Trust are using the blank space on the sign at the foot of Eccles Pike as a commemorative memorial for Highley Sugden, who was a long term supporter of the National Trust and lived in Chapel-en-le-Frith. A memorial day is being held on the 17th September to unveil the new plaque. Due to the closure of Town End Post Office, a new bus stop is being considered as near to Market Place as possible and two new options have been sent for Councillors opinions. The sites that have been identified are outside the Charity Shop and near the chemist. Although Councillors applauded the idea, these were deemed unsuitable for the following reasons:
Members have suggested that the current bus stop on the northern side (outside Cromwell House) is easily accessible. The new bus stop on the southern side could be situated outside High Peak 4x4. No objection. Members would like conditions to be included that would prohibit the servicing of HGV’s and restrict the numbers of vehicles that can be kept overnight at any one time. 10/113 Appeals None 10/114 Notifications None 10/115 Conservation Areas The patch of tarmac on the kerb opposite the Kings Arms will be replaced with stone. Mike Darling is investigating the PVC pallets that are placed along Castleton Road to prevent vehicular access as they are an eye-sore. High Peak Borough Council will be asked to trim back the hedges on Market Street next to Morrisons garage as they are obstructing the pavement. County Highways will be asked to cut the grass next to the by-pass. 10/116 Public Footpaths None 10/117 Correspondence The car park on Hayfield Road is currently owned by Barratts and is due to be transferred to HPBC once it is in a ‘suitable state’. DCC Highway engineers will undertake an inspection of the car park to assess the nature of any remedial work that may be required before the transfer. Barratts will then be contacted with details of the works required. Currently there are no parking restrictions in Whitehough which means no enforcements can be carried out. Councillor Martin and Councillor FP Harrison will meet with Isobel Mulligan in Whitehough to discuss the problems and see if parking restrictions can be put in place. A letter has been received from Mr. GA Harper of Eccles Road regarding the increase in both frequency and size of agricultural vehicles from High Courses Farm, from a company called Smith Plant Hire. A copy of the letter has been forwarded onto Mr Ellis at HPBC and a reply will be sent to Mr. Harper. 10/118 Any Other Business Due to the merger with Staffordshire Moorlands, the dates of HPBC Development Control Committee will be changing.
